This contract is awarded as no cost, the contractor will recoup all conference costs associated with the preplanning, content logistics, travel in support of the conference, execution and wrapup for each conference in the form of revenue from attendee registration, exhibitor, and sponsorship fees from the conferences, andor other fees collected as payment for performance under the pws.

The contractor shall conduct site evaluations from responsive offerors, provide a trip report of site inspections performed, and provide a summary report of offerors to the cor. The contractor shall perform onsite inspection for lodging, food, and av. The contractor shall conduct final site readiness inspection review meetings.

The City of Edmond uses a Mastercard purchasing card for order placement and payment. Suppliers who accept credit cards should anticipate that some or all orders may be paid using the purchasing card. The City of Edmond does not pay credit card convenience fees.

The work shall be commenced on a date to be specified in a written order of the parish and shall be completed within intcompletiontime calendar days from and after said date.

Monthly certificates for partial payment will be issued, typically covering 90% or 95% of the work performed and materials stored, with final payment made after project acceptance and lien certificate clearance. Retainage fees will be applied to contracts of $100,**** or more.

The contractor warrants and guarantees to owner that all materials and equipment will be new unless otherwise specified and that all work will be of good quality and free from faults or defects and in accordance with the requirements of the contract documents. If, after the approval of final payment and prior to the expiration of one year after the date of substantial completion or such longer period of time as may be prescribed by law or by the terms of any applicable special guarantee required by the contract documents, any work is found to be defective, contractor shall promptly, without cost to owner and in accordance with owners written instructions, either correct such defective work or if it has been rejected by owner, remove it from the site and replace it with nondefective work.

The award of the contract, if it is awarded, will be to the lowest responsible bidder, in accordance with state law.

Only the contractors licensed by the state to do the type of work involved can submit a proposal for the work. The owner will conduct investigations to establish the responsibility, qualifications and financial ability and stability of the bidder.

If the contractor neglects, fails or refuses to complete the work within the time specified, or any proper extension thereof granted by the owner, the contractor agrees to pay the owner liquidated damages for each and every calendar day that the contractor shall be in default after the time stipulated in the contract for completing the work.

Each bidder shall visit the site of the proposed work and fully acquaint itself with all surface and subsurface conditions as they may exist so that it may fully understand this contract.

All samples will have been checked by and stamped with the approval of contractor identified clearly as to material, manufacturer, any pertinent catalog numbers and the use for which intended. At the time of each submission, contractor shall in writing call owners attention to any deviations that the shop drawings or samples may have from the requirements of the contract documents.

All protests must be made in writing, and shall be concise and logically presented to facilitate review by the parish. The written protest shall include: the protesters name, address, and fax and telephone numbers and the solicitation, bid, or contract number; a detailed statement of its legal and factual grounds, including a description of the resulting prejudice to the protester; copies of relevant documents; all information establishing that the protester is an interested party and that the protest is timely and; a request for a ruling by the agency and a statement of the form of relief requested. The protest review shall be conducted by the parish procurement department. Only protests from interested parties will be allowed. Protests based on alleged solicitationimproprieties that are apparent before bid opening, or the time set for receipt of initialproposals must be filed with and received by the procurement department before thosedeadlines. Any other protest shall be filed no later than ten 10 calendar days after the basis of theprotest is known, or should have been known whichever is earlier.

Incompetence will constitute cause for rejection. If the parish determines that the bidder is not responsive or responsible for any reason whatsoever, the bid may be rejected. Failure of the successful bidder to execute the agreement and deliver the required bonds within twenty 20 days of the notice of the award shall be just cause for the owner to annul the award and declare the bid and any guarantee thereof forfeited.
