The bid notice states that the contractor shall substantially complete the work within 180 calendar days after the effective starting date for the project as specified in the City's notice to proceed. The agreement also states that the contractor shall complete the services within one hundred eighty 180 calendar days of the notice to proceed.

The City of Sherman ordinarily requires thirty 30 days after receipt of invoice, materials or service for payment. Proposals which call for payment before the elapse of 30 days from receipt of invoice, or cash discounts given on such payment, will be considered only if in the opinion of the City the review, inspection and processing procedures can be completed as to the specific purchases within the specified time. It is the intention of the City of Sherman to make payment on completed orders within thirty 30 days of receiving invoicing unless unusual circumstances arise.

The scoring criteria for proposals are: overall design 30%, pricing 30%, references 20%, and construction schedule 20%. The City of Sherman reserves the right to reject any, or all, proposals or to waive technicalities at its option when in the best interests of said City.

Proposers must include conceptual drawings, a proposed construction schedule, a proposed pay schedule, a minimum of three references, and photos of similar completed projects with dates and locations. Additionally, proposers must provide a list of company representatives with their certifications and licensure, if available, and information regarding the proposed safety surface. Required documents include SAMs verification, certificate of insurance, affidavit of ownership, CIQ form, verifications form, and ability to provide payment, performance, and maintenance bonds.

The bid notice states that if contractor fails to timely perform or complete any of the services required under the terms of the agreement documents, contractor shall pay Sherman the sum of two hundred fifty and 00/100 dollars (****) for each calendar day in which the services are not completed, not as a penalty but as liquidated damages. The City also reserves the right to terminate the contract with ten 10 days in the event the successful proposer fails to meet delivery schedules or otherwise fails to perform.

Respondents are encouraged to visit the site and take pictures to ensure dimensions are accurate, delivery trucks can enter and unload, and to confirm the ability to install temporary barriers and/or fencing to protect the area during construction. Old Settlers Park is a public park, and all potential proposers are welcome to visit the site at their convenience.

The total budget for the project is $200,000.

The bid notice states that this is a fiscal year end sensitive item and requires delivery prior to 9/30/26.

The University of Louisiana at Lafayette adheres to Net 60 payment terms. All other payment terms must be disclosed with the bid, as stricter payment terms may lead to bid rejection.

The manufacturers standard published warranty and provisions shall apply, unless more stringent warranties are otherwise required by UL Lafayette and specified in the solicitation. In such cases, the bidder and/or manufacturer shall honor the specified warranty requirements, and bid prices shall include any premium costs of such coverage.

The intent is to award this bid to the lowest responsible and responsive bidder. UL Lafayette reserves the right to award items separately, grouped, or on an all-or-none basis, as deemed in its best interest.

Bid submissions must be signed by a person authorized to bind the vendor. In accordance with Louisiana R. S. 39:1594, the person signing the bid must be a corporate officer, a member of a partnership, or an authorized representative with supporting documentation of authority. Bidders must also submit a certificate of insurance with the bid submission or provide specific policy details.

Failure to deliver within the time specified in the bid award will constitute a default and may be cause for contract cancellation. Where the university has determined the vendor to be in default, UL Lafayette reserves the right to purchase any or all goods or services covered by the contract on the open market and to surcharge the vendor with costs in excess of the contract price.
