The City of Lowell is seeking bids for asphalt as needed, including summer and winter mixes, in strict accordance with the attached specifications. The contract term will be from July 1, 2026, to June 30, 2027. Bids must be submitted in sealed envelopes and will be publicly opened on June 9, 2026, at 11:00 AM EST. Requests for clarification of specifications must be submitted in writing no later than ten business days prior to the due date. Bidders are required to acknowledge all addenda. A certified check or bid bond is required with the bid, and a performance bond and payment bond are required prior to contract execution. Bidders must submit brochures with their bid and clearly state their terms of sale, maximum delivery time, and warranty conditions. Awards will be made to the lowest responsible bidder. The city is exempt from federal excise taxes and Massachusetts sales tax. The contractor is responsible for unloading, assembly, and installation of equipment, as well as cleaning up the site. Liability insurance, including workers' compensation and public liability insurance, is required. The contractor guarantees all equipment, materials, and workmanship for one year after final acceptance. Samples may be required before or after award. The bidder to whom a contract is awarded guarantees to the city of Lowell all equipment, materials and/or workmanship for a period of one 1 year after final inspection and acceptance and shall replace promptly any defective equipment, materials and/or workmanship required without additional cost to the city.

If it is specifically stated elsewhere in the bid documents that samples are required, full size samples must be submitted not later than the official bid opening.
The purchasing agent also reserves the right to reject the bid of bidder who has previously failed to perform properly or complete on time contacts of similar nature or a bid of a bidder who investigation shows is not in a position to perform the contract.
