ODOC may award one or more contracts based on the lowest responsive bids by responsible bidder per line item, groups of items, or all or none, whichever is in the best interest of ODOC. Preferences for Oregon goods and services, and resident bidders will be applied.
Bidders must submit bids that conform to the requirements of the ITB. Failure to supply all required information shall be cause for bid rejection. ODOC reserves the right to investigate and evaluate, at any time prior to award and execution of the contract, a bidder's responsibility to perform the contract.
If contractor fails, neglects or refuses to pay promptly as due, any claim for labor or services furnished to the contractor or any subcontractor by any person in connection with the goods provided under this contract, the state may pay such claim and charge the amount of the payment against funds due or to become due the contractor under this contract.
ODOC reserves the right to request samples after bid closing from one or more bidders during the evaluation process. If samples are requested by ODOC, bidder shall deliver samples to ODOC within four (4) days after the date of the request.
