medical grade gases at one VA
medical facility, primary care clinics, and community-based outpatient clinics. Contractor must be a
medical gas manufacturer/deliverer registered with the FDA and in good standing. Deliveries must conform to USP, NFPA 55, NFPA 99, and applicable OSHA regulations. Deliveries must be monitored by qualified VA personnel. A direct phone number and email address for placing orders must be provided. Delivery is to the VA facility during specified hours. A list of authorized ordering officials will be provided. Contractor personnel must have a distinctive appearance and provide 24-hour notice before delivery. Emergency delivery fees are allowed. Safety Data Sheets (SDS) must be provided with each delivery. All delivery charges must be included in the unit price. Deliveries are FOB destination. The contract period is from 10/01/2025 to 09/30/2026. The contractor must comply with all applicable federal, state, and local regulations. The contractor and their personnel are subject to VA policies regarding information security. The contractor must complete privacy training annually. The contractor shall incorporate the substance of this clause in all subcontracts. The government reserves the right to inspect or test any supplies or services. Changes in the terms and conditions of this contract may be made only by written agreement of the parties. This contract is subject to 41 U. S. C. chapter 71, contract disputes. The contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the contractor. The contractor shall submit an original invoice and three copies or electronic invoice, if authorized, to the address designated in the contract to receive invoices. Invoices must include specific information. Payment shall be made for items accepted by the government. The government will make payment in accordance with the prompt payment act. The contractor shall indemnify the government against liability for patent infringement. The contractor shall comply with all applicable federal, state, and local laws, executive orders, rules, and regulations. The contractor agrees to comply with 31 ****, 18 U. S. C. 431, 40 U. S. C. chapter 37, 41 U. S. C. chapter 87, 49 ****, and 41 U. S. C. chapter 21. Any inconsistencies in this solicitation or contract shall be resolved by giving precedence in the following order. The contractor must ensure that the data transmission method and format are through one of the following. The contractor shall submit payment requests in electronic form. Exceptions may apply for certain circumstances. The contracting officer reserves the right to designate an administrative contracting officer (ACO) for the purpose of performing certain tasks in the administration of the contract. The contract incorporates one or more clauses by reference. The offeror certifies that it will comply with the limitations on subcontracting requirements. The offeror must select the applicable provision below, identifying itself as either a manufacturer or nonmanufacturer. The offeror acknowledges that this certification concerns a matter within the jurisdiction of an agency of the United States. A false, fictitious, or fraudulent certification may render the offeror subject to criminal, civil, or administrative penalties.
