The Commonwealth intends to make a single award to the lowest responsive and responsible bidder. it is the intent of the commonwealth to make a single award of items listed in the ifb to the lowest responsive and responsible bidder.

Prior approval of samples is mandatory. Submit standard size carpet samples of each type, in each specified pattern, color, and construction. Final sample submittal requires two production quality samples for each carpet type. Vinyl or aluminum edge moldings strip require two pieces of each for review.

Bids must be received prior to the bid opening date and time listed above. If they are not received on time, bids cannot be accepted. The bidder assumes the risk of any delay in the mail or in the handling of the mail by employees of the school district.

Normal payment terms are net 30. Payment will not be issued for inaccurate invoices until corrected. Any payment terms will be applicable from the date of receiving the accurate invoice approved between both parties.

Every unit delivered must be guaranteed against faulty material and workmanship for a period of at least one year from date of delivery. If during this period such faults develop, the successful bidder agrees to replace the unit, or the part affected without cost to the school district.

The award will be recommended to the lowest responsive and responsible bidder who meets all the specifications requested. Awards will be made to the lowest responsible bidder, taking into consideration the reliability of the bidder, the quality of the materials, equipment, or supplies to be furnished, their conformity with the specifications, the purposes for which required, and the terms of delivery.

In determining the qualifications of a bidder, the record of performance of any similar contract previously entered with any bid participant or any other public body will be considered. Vendors currently on the NYS Labor Department debarred list will not be considered for award of this contract.

A contract may be canceled at the successful bidder's expense upon nonperformance of contract. Cancellation of contract for any reason may result in removal of the successful bidder's name from mailing list for future proposals for an indeterminate period.

The school district reserves the right to request a representative sample of the item quoted upon either prior to the award or before shipments are made. If the sample is not in accordance with the requirements of the specification, the school district may reject the bid or, if award has been made, cancel the contract at the expense of the successful bidder.

No interpretation of the meaning of the specifications or other contract documents will be made to any bidder orally. Every request for such interpretation should be in writing, addressed to the school district, not later than five 5 days prior to the date fixed for the opening of bids.

Monroe 2 Orleans BOCES reserves the right to reject any bid for not following the above instructions and/or meeting the specifications and general terms and conditions. Delivery and placement of portable restroom units must be completed by September 21, 2026. Removal of all units must be no later than November 2, 2026, unless otherwise directed by the city.

The award will be based on evaluation criteria including relevant experience and qualifications (30 points), technical approach and methodology (25 points), staffing and emergency response capability (20 points), references and past performance (10 points), and cost proposal (15 points).

Proposers shall demonstrate experience providing portable restroom services for public events, ability to provide sufficient inventory and staffing, appropriate business licensing and permits, and references from at least three municipal, governmental, or large-event clients. Compliance with all applicable federal, state, and local regulations is required.

Any actual prospective bidder, proposer, respondent, or contractor who is aggrieved may protest in writing no later than fourteen (14) days after the acceptance of the bid.

Respondents that fail to comply with licensing requirements may subject their statement of qualifications to being rejected as nonresponsive. Failure of a successful respondent to accept contractual obligations may result in a non-award.

The period of performance is from award date to 07/31/2027.

Workmanship warranty for one year. Equipment warranty by manufacturer.

The government will award a contract to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered. The following factors will be used to evaluate offers: 1. Cost/price, 2. Technical capability to meet the government's need for project description, 3. Personnel qualifications, 4. Past performance.

The contractor shall perform work in accordance with best common practices and standards, including safety and hazard awareness, and abide by housing codes.

The contractor must submit all materials to be used for renovation and be approved by KHC.

Protests must be served on the contracting officer by obtaining written and dated acknowledgment of receipt. A copy of any protest must be received in the designated office within one day of filing a protest with the GAO.

Failure of your acknowledgement to be received at the place designated for the receipt of offers prior to the hour and date specified may result in rejection of your offer. Contractors perform at their own risk when accepting direction from unauthorized officials.
