The project start date is 15 calendar days from the issuance of notice to proceed, with substantial completion within 45 days and final completion within 105 days.

Oregon Military Department will withhold retainage. The amount withheld from progress payments will be five percent (5%) of the payment.

Progress payments will be made based on applications submitted by the contractor, processed by the owner's representative. Payments are typically made around the 45th day following submittal and approval. Retainage of 10% will be withheld from progress payments. Final payment will be made upon acceptance of the work.

A one-year warranty is required for the applied slurry seal material. If the material becomes unsealed or peels loose within one year, it must be repaired by the contractor at no additional cost to the city.

Bidders must be qualified contractors with experience, financing, and equipment to perform the work. The owner has the right to take necessary action to determine the bidder's ability to perform satisfactorily.

Liquidated damages will be assessed for each day the work remains uncompleted beyond the specified completion date or any granted extension. The amount of liquidated damages is specified in the special provisions based on the contract price.

Failure to execute the agreement and furnish the required performance bond and certificates of insurance within ten calendar days from the date of the notice of award may result in the forfeiture of bid bond and abandonment of contract rights.
