Deliveries and/or pickups shall be made within five (5) business days after receipt of a release notice. Unless specifically directed otherwise, all services shall be delivered and/or picked up Monday through Friday between the hours of 8:00 a. m. and 2:00 p. m. Payment for goods and/or services shall be made in due course of payments of LBPU D after completion of delivery and acceptance by LBPU D and upon receipt of an invoice from the contractor. Payment will usually be made no more than thirty (30) days after receipt of the invoice. Contractor warrants that all services performed under this contract shall be in good working order and shall conform to the contractor's published specifications. Contractor shall guarantee all parts, materials, and labor against failure due to defective material and/or faulty workmanship for a minimum of one (1) year from the date of acceptance. The award will be based on the unit prices, percentage discounts given, and in accordance with the provisions of the specification requirements stated herein. Each bidder shall be fully qualified by ability, knowledge, and experience to satisfactorily perform the goods and/or services required. The contractor must have been in business providing welding, machining, and fabrication services for at least the last three (3) years. Failure to respond to emergency service or failure to provide competent responsive service may be cause for termination of the contract or LBPU D may exercise the right to call another company to respond. The expense of this service call shall then be charged to and paid by the contractor. Each bidder shall be required to submit, in accordance with document 00 21 00 instructions to bidders and document 00 45 13 statement of qualifications soq for construction work, a statement of qualifications.

The city shall assess liquidated damages in the amount of $500 per working day for delays in completion of each authorized work assignment, as provided in the contract documents.
