Net 30 days after government acceptance of a proper invoice, which shall only be submitted after services have been performed. Advance payments will not be made. Contractor may submit invoices monthly, quarterly or annually, in arrears.

The government will award an order to the lowest price technically acceptable quoter whose quote conforming to the solicitation will be the most advantageous to the government.

The vendor shall demonstrate that its proposed technical solution meets or exceeds the stated requirements. The contractor shall have the technical understanding, skill, resources, and training to provide the required services.

Quoters are afforded the opportunity to inspect the existing tank, instrumentation and site, at their own expense, prior to the date set for receipt of quotes by contacting the contract specialist/contracting officer identified herein to schedule an appointment.

Quoters that fail to complete the required representations and certifications, or reject the terms and conditions of the solicitation may be excluded from consideration. Failure on any single subitem under technical capability will result in an overall rating of fail and technical disqualification.

Responses must be received by the TABC no later than August 14, 2026, at 5:00 PM CDT.

The vendor shall invoice the service plan and any replacement parts separately within two weeks following the initiation of the annual service plan or the delivery of replacement parts. All invoices shall comply with applicable TABC standards and requirements.

Replacement parts must be manufacturer approved and covered by the manufacturers warranty.

The TABC shall make an award to the respondent that, in the sole judgment of the TABC, provides the best value to the state of Texas.

Respondents must have been in business for a minimum of five years or have principals with recent ownership/executive management experience in a similar company. They must be certified to work with and demonstrate experience in providing service and support for Chromeleon CDS software and the specified Thermo Fisher Scientific instruments.

The TABC may make site visits to any or all respondents. Failure to permit or participate in a site visit may eliminate the respondent from further consideration.

Respondents must notify the TABC POC of any ambiguities, conflicts, discrepancies, exclusionary specifications, omissions, or other errors noted in the solicitation by the deadline for questions in the schedule of events.

Failure to comply with prohibited communication rules may result in disqualification. Failure to submit all required documents in the required formats and properly labeled may result in disqualification. Failure to properly and timely notify the POC of issues may result in waiver of claims and no entitlement to additional compensation or time.

The total compensation for services shall not exceed $60,000.

The government intends to negotiate with only one source.
