The delivery of services must be performed within the time periods specified in the contract. The contract shall end on the later of complete delivery and acceptance of the awarded items, the expiration of any specified warranty and maintenance period, payment by the Commonwealth for the items received, or any expiration date identified in the purchase order.

The Commonwealth shall make reasonable efforts to make payment by the required payment date, which is 30 days after a proper invoice is received if a specific due date is not in the contract. Payment may be delayed if the invoice amount is not based on contract prices. Interest may be paid if payment is not made within fifteen days after the required payment date. The Commonwealth may also use a purchasing card for payments, with any associated fees being the contractor's responsibility.

The contractor warrants that all items furnished and services performed shall be free from defects in workmanship or materials. Unless otherwise stated, all items are warranted for one year following delivery and acceptance by the Commonwealth. The contractor shall repair or replace any defective items at no additional cost.

It is the intent of the Commonwealth to make a single award to the lowest responsive and responsible bidder. The Commonwealth reserves the right to award by line item if it determines it to be in the best interest of the Commonwealth.

To be eligible for selection, a bid must be timely received from a bidder and properly signed by the bidder.

The contract may be terminated for default if the contractor fails to meet various obligations, including timely delivery, satisfactory performance, or compliance with contract terms. The contractor may be liable for excess costs incurred by the Commonwealth in re-procuring services. Failure to comply with enhanced minimum wage provisions may result in sanctions, including termination of the contract or nonpayment.

All bidders, prior to submitting a bid, must visit the site to completely familiarize themselves with all of the agency's needs and requirements. Vendors shall contact Jim Niehenke at **** x204 to schedule an appointment to visit the site.

In the event of a controversy or claim, the contractor must file a written claim with the contracting officer within six months after the cause of action accrues. If mediation is not agreed to or is unsuccessful, the contracting officer shall issue a final determination within 120 days of claim receipt. The contractor may file a claim with the Commonwealth Board of Claims within fifteen days of the mailing date of the determination denying a claim or within 135 days of filing a claim if no extension is agreed to.

The contract is for an initial two-year period from July 1, 2026, until June 30, 2028. The borough reserves the option to renew the contract for two additional one-year periods. The contractor shall begin corrective work no later than 8:00 am of the second day following receipt of directive for correction on nonemergency problems and two hours after notification for snow removal/sanding and other emergency problems.

Payment under this contract shall be based on the prices set forth in the proposal. Disbursement of money to a person, firm or corporation will be made only after all the various receivable accounts of the general government and any municipal utility or enterprise have been reviewed for outstanding balances owed, and the disbursement will be reduced by setting off the amount of any delinquent indebtedness due the Kodiak Island Borough from such person, firm or corporation.

The bidder warrants all articles, materials, and equipment supplied under a contract resulting from this bid conform to the specifications of this contract, to be fit and sufficient for the use specified, to be of merchantable quality, and to be free from defect of materials or workmanship.

Award shall be made to the responsive, responsible bidder offering the lowest total bid for the work to be awarded. If there is a tie between two bidders, the lowest average cost of the alternative bid 1 will determine the successful bidder.

In case of failure on the part of the contractor, for any reason, except with the written consent of the borough, to complete the furnishing and delivery of materials and the doing and performance of the work before the aforesaid date, the borough shall have the right to deduct from any money due or which may become due the contractor, or if no money shall be due, the borough shall have the right to recover liquidated damages as described in the special conditions for each calendar day elapsing between the time stipulated for achieving substantial completion of an individual phase and the actual date of completion of that phase in accordance with the terms hereof.

There will be a mandatory pre-bid conference on May 28, 2026, at 10:00 am local time at Borough Conference Room 121, 710 Mill Bay Road, Kodiak, AK, ****.

Questions are due: June 1, 2026, at 1:00 pm.

The delivery schedule from date of contract award to completion shall be 12 weeks or less.

The bid notice requests payment terms of Net 30 or discount.

The bid notice requests warranty information to be included in the quote.

The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the government, price and other factors considered, using the Lowest Price Technically Acceptable (LPTA) method.

Offerors are required to submit with their quote enough information for the government to evaluate the requirements detailed in this solicitation, including SAM UEI, TIN number, CAGE code, contractor name, payment terms, point of contact name and phone number, email address, warranty, date offer expires, FOB destination, and estimated delivery lead time.

The contractor shall provide material samples, product data from manufacturers/suppliers, and standard color charts/catalogues for proposed materials and finishes as applicable.

The period for questions regarding this RFQ will end at 8:00 AM PDT on May 11, 2026.
