The contractor agrees that all materials furnished shall be free from all inherent defects in design, workmanship and material, and shall give proper and continuous service. The contractor shall immediately repair or replace any materials that prove defective within one 1 year from the date of delivery.

The city intends to award all groups to one supplier based on the lowest evaluated total for all groups. However, bid groups may be awarded separately if in the city's best interest. In the event the bidder fails to deliver the material within the time limit, the contractor shall pay liquidated damages to the city at the rate of $30 per day for each calendar day the complete order is received late. The total amount of liquidated damages shall not exceed 10 percent of the net cost of the order.
