Contractor warrants that all goods shall be new, unused, current production models, free from defects in materials, design and manufacture for the duration of the contract, and meet or exceed all specifications.

ODOC may award one or more contracts based on the lowest responsive bids by responsible bidder per line item, groups of items, or all or none, whichever is in the best interest of ODOC, subject to will call options and applicable preferences for Oregon goods/services and resident bidders.

Bidders must submit bids that conform to the requirements of the ITB, including all required information and certifications. Failure to supply all required information shall be cause for bid rejection. Bidders must also demonstrate responsibility to perform the contract.

If contractor breaches any provision of the contract, the state reserves the right to cancel the contract and contractor shall be liable for any and all damages suffered by the state, including incidental and consequential damages.

ODOC reserves the right to request samples after bid closing from one or more bidders during the evaluation process. If samples are requested, bidder shall deliver samples to ODOC within four (4) days after the date of the request.

To be considered, ODOC must receive a protest of contractual terms or specifications by the deadline specified in Section 1. 1 Schedule of Events.

Contact with other ODOC staff regarding this ITB without prior clearance from the single point of contact will lead to disqualification. Failure to supply all required information shall be cause for bid rejection.

A bid bond or certified check in the sum of five percent (5%) of the amount of the bid will be required from each bidder to be retained as liquidated damages in the event the successful bidder fails, neglects, or refuses to enter into said contract for the construction of said public improvements for said project, and furnish the necessary bonds within ten (10) days from and after the date the award is made.
