Invitation to Bid for unsalted margarine butter. Bids are due August 10, 2026. Delivery to ODOC's Central Distribution Center in Salem, OR. Samples may be requested after bid closing. Preference given to Oregon goods/services and resident bidders. Bids must conform to specifications, including minimum fat content, dairy-free, and unsalted requirements. No peanut, soybean, corn, sunflower, or cottonseed oil allowed. Goods must be U. S. Grade A or better and allow freezing without discoloration. Packaging in 1-pound prints. Minimum six-month shelf life required.
First delivery or will call, as applicable shall occur after the issuance of a purchase order. Remaining FTLs to be delivered **** days apart, after previous shipment until the contracted quantity of goods has been fully received and accepted by ODOC. The purchase order issued to the awarded bidder will indicate the delivery dates and must be confirmed with the ODOC warehouse receiving staff.
Payment for completion of state contracts is normally made within 30 days following the date the entire order is delivered and accepted or the date the invoice is received, whichever is later. After 45 days, contractor may assess overdue account charges up to a maximum rate of two-thirds of one percent per month (8 APR) on the outstanding balance.
All implied and expressed warranty provisions of the Uniform Commercial Code (ORS Chapter 72) are incorporated. Contractor warrants that all goods shall be new, unused, current production models, free from defects in materials, design and manufacture for the duration of the contract, and meet or exceed all specifications.
ODOC may award one or more contracts based on the lowest responsive bids by responsible bidder per line item, groups of items, or all or none, whichever is in the best interest of ODOC, subject to will call options and applicable preferences for Oregon goods/services and resident bidders.
Bidders must submit bids that conform to the requirements of the ITB, including all required information and certifications. Failure to supply all required information shall be cause for bid rejection. Bidders must also demonstrate responsibility to perform the contract.
If contractor breaches any provision of the contract, the state reserves the right to cancel the contract and contractor shall be liable for any and all damages suffered by the state, including incidental and consequential damages.
ODOC reserves the right to request samples after bid closing from one or more bidders during the evaluation process. If samples are requested, bidder shall deliver samples to ODOC within four (4) days after the date of the request.
To be considered, ODOC must receive a protest of contractual terms or specifications by the deadline specified in Section 1. 1 Schedule of Events.
Contact with other ODOC staff regarding this ITB without prior clearance from the single point of contact will lead to disqualification. Failure to supply all required information shall be cause for bid rejection.
