The contractor must establish and maintain an information security program. The contractor must carry professional liability insurance and cyber breach insurance. The contractor's liability for actual, direct damages is limited to 200% of the fees paid by the state during the previous twelve months. The contractor must indemnify, defend, and save harmless the state and its officers, agents, servants, and employees from and against any and all third-party claims. The state will not indemnify, defend, or hold harmless the contractor.
