Failure to deliver within the time specified or to provide the services as specified in the bid will constitute a default. The contractor agrees to defend any claim or action, or take other appropriate measures, to indemnify, and hold harmless, the state, its officers, its agents, and its employees from and against all claims and actions for bodily injury, death or property damages caused by the fault of the contractor, its officers, its agents, or its employees. The contractor shall comply with the provisions of La. R. S. 23:995 and federal law pertaining to everify in the performance of services under the contract.
