The lessee will lease the land from the city for the cost of the metered rate of water in accordance with **** of the Arvada City Code. The 2026 rate is $3. 52/1000 gallons. The final yearly water bill is issued at the end of the calendar year and shall be paid by January 15 of the following year.

The city is a best value agency. The award will be to the vendor who receives the highest score from the city's RFP evaluation committee, based on criteria including stewardship of the property, proposed operation, community engagement, experience, ability to meet equipment and financial demands, and performance measures.

Vendors must be engaged in supplying products or services, have an established satisfactory record of performance for at least two years, and have sufficient finances and structure to execute contract requirements. The city may require evidence of qualifications, including financial, technical, and past performance.

If a vendor withdraws an offer within 90 days of the deadline, the city may suspend the vendor and not accept any offer from them for a six-month period. Failure to complete work during the term of the agreement shall be deemed a breach.

A pre-proposal meeting will be held virtually on August 12, 2026, at 10:00 AM MT. While not explicitly stated as mandatory, vendors are encouraged to make all investigations necessary to inform themselves of the facilities affected by the delivery of products and services.

Kent State University will endeavor to use any cash terms offered, and these could be considered in determining the final net price. The period for cash discounts commences on the date of delivery or receipt of a correctly completed invoice, whichever is later.

Vendor guarantees all products and installation against any defect. A comprehensive list of all authorized service centers must be provided by the supplier.

Selection and award of contract will be made to the vendors whose proposal, in the sole opinion of Kent State University, represents the best overall value to the university. Factors include products/services, ability to fulfill the contract, general responsibility, past performance, payment terms, and cash discounts.

Vendors must demonstrate experience in running café operations, especially in small or corporate settings, and possess professional qualifications for their staff. They must also acquire and maintain an active food service license and have ServSafe Ohio Level 2 certification.

Any breach of contract terms, including time periods, may be just cause to terminate the contract without prior notice. Termination resulting from breach could lead to suspension from proposing on future university projects for up to three years.

Requested samples necessary for evaluation must be provided without cost or obligation to Kent State University.

Proposals received after the stated date and time, or those that do not contain the required information, will be considered incomplete and unresponsive, and will be disqualified. Failure to provide adequate information in a timely manner may also lead to disqualification.

The contract will be awarded to the best value trade off proposal.

The contractor shall provide a written workmanship warranty for a minimum period of one 1 year from the date the work is completed for repairs, installations, or modifications performed on dumpsters, compactors, rolloff containers, or other waste management infrastructure. Proposers offering extended workmanship warranties for repair or installation services may receive favorable consideration during proposal evaluation.

Respondents shall submit a comprehensive qualifications package demonstrating the firms experience, operational capacity, staffing resources, regulatory compliance, technical expertise, and ability to successfully perform campus-wide solid waste collection, recycling, and refuse management services. The university reserves the right to reject any proposal submitted by a proposer lacking required licenses, certifications, insurance coverage, regulatory authority, or demonstrated capability to perform the required services safely and lawfully.

Tuskegee University reserves the right to assess reasonable service credits, invoice deductions, corrective action requirements, or other contractual remedies for repeated service failures, missed service events, failure to meet response times, or operational deficiencies attributable to the contractor. Prior to assessment of any service credit or contractual remedy, Tuskegee University may provide written notice identifying the deficiency and a reasonable opportunity for corrective action where appropriate.

The university reserves the right to require the immediate removal of any contractor employee, subcontractor, vendor representative, or assigned personnel for unsafe behavior, misconduct, regulatory violations, security concerns, or failure to comply with university policies or instructions.
