The city may consider the bidders responsibility, including whether the bidder has in operation a parts and service facility adequate for the services specified, employs qualified personnel, and has previous performance under city contracts or comparable contracts.
If the contractor fails to deliver within the time stipulated, the city may purchase in the open market and the contractor shall reimburse the city for any excess costs.
Samples submitted by bidders on items which they have received an award may be retained by the city until the delivery of contracted items is completed and accepted.
The city reserves the right to reject any bid where prices offered are unbalanced or otherwise inconsistent with current market prices.
