Substantial completion is expected by September 11, 2026, and 100% completion by September 28, 2026.

Progress payments will be made no less than monthly for properly submitted requests. Final payment will be made within thirty (30) days after final acceptance and receipt of project manager's confirmation.

Contractor warrants all workmanship, equipment, and materials for a period of two (2) years following final completion of the project.

Contractor must confirm employment eligibility of all newly hired employees through the Everify program or the Department program. Contractor must also comply with Colorado labor laws regarding employment eligibility.

Liquidated damages of **** per day will be assessed for late substantial completion and late final completion.

Gypsum may terminate the agreement if the contractor fails to perform adequately, proceeds in willful violation of contract documents, delays performance unnecessarily, acts in bad faith, is insolvent, or for other serious cause that jeopardizes project completion.

The work will be substantially completed on or before 09/15/2026, and completed and ready for final payment on or before 09/25/2026.

Progress payments and retainage are governed by PA ****, No. 524 MCLA **** et seq. The contractor's representative will submit applications for payment in accordance with Article 14 of Section 00 72 00.

Contractor will keep in good order and repair any defect in the work for a period of one (1) year from the date of payment of the final estimate, due to improper materials, defective equipment, workmanship, or arrangements.

The contract will be awarded to the lowest responsive and responsible bidder.

No bid will be considered from any bidder unless known to be skilled and regularly engaged in work of a character similar to that covered by the contract documents. Bidders must furnish evidence of experience, familiarity with similar work, and financial ability.

Liquidated damages will apply to the substantial completion date. Contractor to pay owner $1,**** for each day that expires after the time duly adjusted for substantial completion until work is substantially complete.

Bidders are responsible for visiting the site to familiarize themselves with local conditions that may affect the cost, progress, or performance of the work.

Questions will be received until 06/30/2026 at 5:00 p. m. No further questions will be answered after this date and time.

Failure to comply with conditions for executing the agreement and furnishing contract security within 15 days of the notice of award may result in bid security forfeiture and annulment of the notice of award.

The contractor is required to inspect the site of the proposed work to satisfy themselves, by personal examination, the location of the proposed work and the actual conditions of the proposed worksite. The contractor is also required to have all subcontractors personally inspect the site.

Bidders must be qualified to provide construction services.
