The award will be based on best value, with cost at 40 points, qualifications and capabilities at 20 points, experience with similar work at 20 points, anticipated project schedule at 10 points, and knowledge of the capital region and geographical area of the project at 10 points. The award of this solicitation will be given to the lowest responsive and responsible bidder based on best value. The contractor must provide emergency maintenance services within 24 hours of the citys request.

Payment will be made to the contractor for work performed under this contract for the quantities of work as determined in accordance with payments for work completed and payments withheld of this contract.

The contractor shall remedy any defects in the work and pay for any damage to other work resulting therefrom that shall appear within a period of eighteen 18 months from the date of final acceptance of the work, unless a longer period is specified.

The city reserves the right to award the contract to a responsible proposer submitting a responsible bid, with a resulting negotiated agreement which is most advantageous and in the best interest of the city.

The city shall be the sole final judge of qualifications of bidder to perform service and reserves the exclusive right to accept or reject any bid as it deems to be in the best interests of the city.

Failure to adhere to the schedule or meet performance standards may result in penalties, including: 5 reduction in payment for delayed work per day.
