The omission of payment terms and/or other information on bid replies may subject it to disqualification.

Macomb Community College reserves the right to reject any or all bids and to award by item, combination of items or lot.

Provide documentation for authorized reseller status for Extron products.

In case bidder fails to make delivery of any item or items within the terms herein specified, or shall make delivery of goods not in accordance with the terms and specifications, the college shall have the right to declare the order canceled and either accept the next lowest bid or again advertise for bids and to hold the original bidder liable for the difference between the amount of its bad and the amount that the board shall in either of such cases be required to pay, or the college may elect to receive the item or items not delivered within the time and hold the bidder responsible for amount equal to ten percent of the amount bid on such items as liquidated damages for the delay, and said bidder in such cases agrees to make payment accordingly.

Samples must be submitted with quotation when a substitute material is quoted. Samples requested must be furnished free of expense, prior to the time designated for the reception of bids and it not be destroyed or required in connection with the award or delivery and will, upon request, be returned at the bidders expense. The college will not be responsible for samples mutilated or destroyed if considered necessary for testing purposes.

The desired and required time of delivery is 260 days. The contractor must obtain final inspection and acceptance by the government for all assets within the RTAT established in the resulting contract, with a requested RTAT of 78 days.

A one-year warranty from the date of delivery is required for supplies of a noncomplex nature.

Award shall be based upon solicitation requirements if no exceptions are indicated or received. Changes or requests for changes after award shall be subject to consideration costs deducted from the unit price.

Offerors must be authorized distributors of the original manufacturer's item and provide proof of authorization on company letterhead, signed by a responsible company official, sent with the offer.

Any asset for which the contractor does not meet the required RTAT will incur a price reduction of xxxx per unit, implemented via a reduction modification at the end of contract performance. These price reductions do not limit other government remedies, including termination for default.

Failure to meet the required RTAT may result in price reductions and potential termination for default.
