Qualifications must be submitted electronically via the BidNet Direct platform no later than 12:00 PM, noon, prevailing time on August 21, 2026.

Submissions will be evaluated based on the qualifications and experience of the individuals who will perform the services, and the qualifications and experience of the firm, including the quality of similar services provided to others relative to performance, and ability to complete the work in accordance with the clients schedule.

Respondents are required to provide documentation demonstrating their experience for each of the services that the respondent requests to be qualified for. Minimum qualifications include admission to the New Jersey bar for a minimum of ten 10 years, a multidisciplinary law practice in civil matters for a minimum of ten 10 years, and experience representing New Jersey public entities.

Responses which, in the judgment of the MCUA, fail to meet the requirements of the RFQ or which are in any way conditional, incomplete, obscure, contain additions or deletions from requested information, or contain errors may be rejected.

Bids must be received by the purchasing agency on the solicitation due date no later than the solicitation due time as set forth in the solicitation. The bid opening date and time is **** at 2:00 pm.

For each financing package, the applicable funding agency will make payments to the financer, including the interest portion, as specified in the applicable payment schedule. These payments shall commence on the dates set in the applicable payment schedule, typically twelve months after the final payment has been made to the applicable GESA contractor.

The award will be made to the responsible bidder with the lowest interest rate, market index, spread basis points, and other fees.

All bidders must be registered to the Pennsylvania Supplier Portal and have a current and active PA vendor number. Bidders must also certify that they are not currently suspended or debarred by the Commonwealth, any other state, or the federal government.

The financer shall reimburse the Commonwealth for the reasonable costs of investigation incurred by the office of inspector general for investigations of the contractors compliance with the terms of this or any other agreement between the financer and the Commonwealth which results in the suspension or debarment of the financer.

No prebid conference will be scheduled.

If a protest is filed by a prospective bidder, it must be filed prior to the bid opening date and time. If a protest is filed by a bidder, it must be filed within seven 7 days after the protesting bidder knew or should have known of the facts giving rise to the protest, but no later than 7 days after the contract award date.

Failure to comply with instructions, submitting bids after the deadline, incomplete bid forms, falsification of information, collusive bidding, or failure to execute the MIPA within 10 days may result in rejection of the bid or cancellation of the award.

Bids are due by Thursday, August 27th, 2026, at 2:00 PM MT.

The county may require up to thirty-one (31) days to process payment after receiving billing in the proper form. For contracts of $150,000 or more, the county shall withhold 5% of monthly partial payments until satisfactory completion.

The contractor warrants that all work, equipment, and materials are free from defects in workmanship and materials for one year after final acceptance.

It is the intent of the county to award an agreement to the contractor who provides the lowest responsive and responsible bid.

The county may investigate the contractor's ability to perform, including bonding capabilities, licensing, financial statements, and past performance. Conditional bids will not be accepted.

Liquidated damages will apply for failure to complete the work by the completion time, with amounts varying based on the original contract amount.

An optional in-person pre-bid meeting or video attendance will be held on July 28, 2026, at 10:00 AM MT at the Colorado Air Space Port.

Any contact with other county personnel or county contractors outside of the purchasing division may be cause for disqualification. Falsifying certifications may lead to prosecution.

Applicants should have significant managerial experience and technical knowledge in several of the various phases of infrastructure finance and P3 development and implementation. The successful candidate should have project experience in one or more of the following sectors: energy generation and transmission facilities, renewable energy, water projects, toll roads, airports, seaports, light rail projects, railroads, or other essential infrastructure sectors. Both P3 and project finance experience is desirable. Prior overseas work experience in challenging environments is highly desirable. Spanish fluency is required for most posts in Latin America, and Portuguese and French fluency is highly desirable for lusophone and francophone countries, respectively. Other foreign language capabilities may also be useful. English speaking assignments may be available in some countries. Candidates should have strong communication and public presentation skills. Candidates must have the ability to work independently and gain the confidence of host government officials and counsel them about policy choices and their consequences. Advisors should be capable of assisting government officials in assessing the optimal project delivery format for their projects with an emphasis on mobilization of private capital. Advisors are expected to assist countries build a lasting legal and institutional framework that will support the development of financially viable infrastructure projects. Candidates must be U.
