The state of Utah requires any person engaging in a construction trade or acting as, or representing oneself as a contractor in a construction trade for which licensure is required be licensed before engaging in that trade or contracting activity. It is unlawful for any unlicensed person to submit a bid for any work for which a license is required.

Any unlicensed person who violates the licensing provision cannot be awarded or accept a contract for the performance of the work.

Material will be delivered on or before the specified dates. Pueblo Water will have the right to cancel the contract for purchase of the material and proceed with purchase of equivalent material at market prices for immediate delivery and hold the bidder liable for any increase in price over and above the prices offered herein if the deadline is missed.

Pueblo Water has the ability to remit payment via Procurement Card (P-Card) or ACH. With ACH, Pueblo Water will remit payment 30 days after receiving an invoice. Terms of sale can be Net 15, Net 30, or Net 60.

Award will be made to the responsive, responsible bidder whose offer, conforming to this invitation for bid, will be most advantageous to Pueblo Water, price and other factors considered.

If a delivery deadline is missed, Pueblo Water may cancel the contract and hold the bidder liable for any increase in price. Termination for default may result in the vendor's name being removed from the approved bid list for two years.

Protests must be submitted within three calendar days after the aggrieved person knows or reasonably should have known of the facts giving rise thereto. For requirements or specifications, a challenge should be made within three calendar days of when the item being protested is known.

Falsifying information in the Proposal Acknowledgement can deem a proposal nonresponsive and ineligible for consideration, and can cause cancellation of an awarded contract. Failure to comply with contract documents, make progress, or perform work within the specified time can lead to termination for default.

Proposals must be uploaded to the Bidnet Direct website no later than 2:00 PM MT on August 12, 2026.

For construction contracts exceeding $150,000, the county will withhold retainage in the amount of five percent (5%) of the total contract amount from progress payments. Retainage will be released in accordance with the terms of the executed contract.

The contractor shall provide manufacturer warranty documentation for installed equipment and a minimum one-year workmanship warranty.

Selection will be based on: Approach to project (30%), Similar project experience and qualifications (20%), Estimated cost of services (40%), and Project schedule and completion plan (10%).

Proposers must submit a statement of qualifications, including references for significantly similar projects with local governments, and a list of all subcontractors including their qualifications.

Communications between a proposer and any member of the selection committee during the selection process, except when expressly authorized, is prohibited and is grounds for disqualification.

All bids submitted by vendors for a specific product must have 30 days prior to bid opening approval of their product which can be initiated by: 1. Submission of working samples per Pueblo Water specifications 30 days prior to any bid opening for a particular product. 2. Submit detailed drawings of sample if applicable. 3. List of users in and out of the state of Colorado. 4. Availability and time for delivery.

If Pueblo Water terminates this contract, in whole or in part, due to Vendor's breach of any provision of this contract, vendor shall be liable for actual and consequential damages to Pueblo Water.

Submission of working samples per Pueblo Water specifications 30 days prior to any bid opening for a particular product is required for product approval.

Any actual or prospective vendor who is aggrieved in connection with either the solicitation or award of a contract may protest in writing to the procurement specialist. The protest shall be submitted within three calendar days after such aggrieved person knows, or reasonably should have known, of the facts giving rise thereto.

Falsifying information in the proposal acknowledgement is cause to deem your proposal nonresponsive and therefore ineligible for consideration. Falsification of this information is also cause to cancel a contract awarded based on one or both of the above preferences.

All pipe furnished shall be manufactured and tested within the continental limits of the United States. Manufacturers of PVC water distribution pipe approved as of 09/16/19 are listed.

Pueblo Water may terminate this contract for default if the contractor fails to comply with contract documents, fails to make progress, acts or fails to act so that future performance is uncertain, or fails to perform work within the specified time and does not cure such failure within a reasonable period after written notice. In the event of termination for default, Pueblo Water may purchase replacement work or materials, and the contractor shall reimburse Pueblo Water for any excess costs incurred.

A submission of a working sample per Pueblo Water specifications is required 30 days prior to any bid opening for a specific product as part of the vendor approval process.

Any actual or prospective contractor who is aggrieved in connection with either the solicitation or award of a contract may protest in writing to the procurement specialist. The protest shall be submitted within three calendar days after such aggrieved person knows, or reasonably should have known, of the facts giving rise thereto. Regarding requirements or specifications set forth in this ITB, it is important for contractors to note that a challenge should be made within three 3 calendar days of when the item being protested is known.
