Solicitation for scheduled deliveries of dairy and juice products for Texas Department of Public Safety, Texas Juvenile Justice Department, and Texas School for the Deaf. Initial contract term is from the effective date to November 30, 2027, with renewal options up to one additional year. Pricing must be firm with escalation allowed annually at renewal or at CPA's discretion, based on CPI or PPI indices. Delivery is FOB destination. Respondents must submit a mandatory price sheet and descriptive literature. Sample testing may be performed post-award. Electronic submission is preferred, but hard copies are accepted. Payment terms for the State of Texas are typically 30 days. Respondents may provide additional discounts.
Contractor shall replace defective products during the initial contract term and any exercised renewals within two weeks of written notice. In lieu of replacement, contractor will refund the full purchase price.
CPA intends to make an award to the vendor providing the best value to the state for each line item, considering compliance with specifications, purchase price, and risk of vendor nonperformance.
CPA may disqualify a respondent if there is an unacceptable risk that it will fail to perform the contract, considering ability, capacity, skill, promptness, character, integrity, compliance with laws, financial resources, and conformity to specifications.
CPA and the customer may exercise contractual remedies in connection with late delivery or noncompliant goods.
Communicating with anyone other than the point of contact, failure to submit required documentation, failure to sign the execution of response, or failure to submit the mandatory price sheet may result in disqualification.
