This is a public tender for dairy and
juice products scheduled deliveries. The initial contract term starts on the effective date set out in a notice of award issued by the Texas Comptroller of Public Accounts (CPA) and automatically expires on November 30, 2026. There are four renewal options, up to one additional year. Responses must be firm, all-inclusive, fixed prices. Price adjustments may be requested annually at time of renewal or at the sole discretion of CPA throughout the term of the contract. The customer may perform sample testing. The response must include a statement that the respondent intends to obtain and maintain for the term of the contract and any renewal periods the minimum insurance coverage specified in the table. The response should also describe other insurance coverage maintained by the respondent in the ordinary course of business and provide proof of same in its response. Respondents must submit their response to CPA before the due date and time indicated on the cover page. CPA will post any addendum to this solicitation on the esbd. Respondents are responsible for checking the esbd for addenda prior to submitting a response. Respondents must acknowledge each solicitation addendum by returning a signed copy of the addendum with its response. Respondents must send all questions regarding this solicitation to the CPA points of contact identified in section a. 11. 4 by the due date in the schedule of events on the cover page. The prebid conference is scheduled for the date listed in the schedule of events on the cover page. The prebid conference is an opportunity for vendors to hear information about the solicitation and ask questions about the solicitation. The solicitation package includes the following documents: part a: special instructions, part b: general instructions and contract terms and conditions, part c: federal conditions, attachment a execution of response, attachment b respondent information, attachment c preferences, attachment d insurance statement of intent, attachment e self insured retention, attachment f requirements and specifications, attachment g estimated delivery frequencies, mandatory price sheet in both . xml and . xlsx format. CPA has reviewed this solicitation and determined there are no probable subcontracting opportunities. If CPA determines that Texas government code **** may apply to a contract award, CPA will instruct the respondent to disclose interested parties to the Texas ethics commission TEC and CPA. CPA may waive minor or immaterial requirements in the submission process. CPA will disqualify any response that does not conform to the solicitation requirements in any material respect as nonresponsive. CPA may disqualify a respondent if there is an unacceptable risk that it will fail to perform the contract. CPA will determine best value for the state as directed by Texas government code **** may break a tie by applying preferences under state law that were claimed in the response. CPA intends to make an award to the vendor providing the best value to the state for each line item. The contractor shall not substitute a contract item or brand without prior written approval from
statewide contract management. The response must clearly state the response due date and time identified on the cover page, schedule of events, and be titled: response submitted for ifb **** dairy and

Respondent must submit one original signed paper copy however, the mandatory price sheet should be submitted in the electronic format requested.
