Payment will be made in accordance with the pricing provided on Exhibit C, and the Texas Prompt Payment Act. hhs system agency will make contract payments in accordance with chapter **** of the texas government code, commonly known as the texas prompt payment act.

Award will be made to the bidder who provides the best value to the state, considering meeting requirements, ability to meet performance/delivery, and price. hhsc shall not be obligated to select the bidder with the lowest price but shall make an award to the bidder who provides the best value to the state of texas.

Bidders must submit a comprehensive response ensuring they meet all requirements, possess required experience and qualifications, and have the capacity to provide the goods/services. to ensure the bidder meets all requirements, possesses the required experience and qualifications, and has the capacity to provide the goods andor services described in this ifb.

Failure to comply with sole point of contact requirements, submitting exceptions to the IFB, including assumptions, not submitting required literature, or failing to monitor the ESBD for addenda may result in disqualification. failure to comply with these requirements may result in disqualification of the response.

Eggs are to be delivered to 5 warehouse locations by the following week. The anticipated purchase order start date is July 30, 2026.

The award will be made to the responsible bidder whose acceptable quote is determined to be the most advantageous to the CDOC, with price and cost being the primary consideration. Other considerations may include sample quality and lead time for delivery.

Any organization that can provide the goods/services as outlined in this DQ is eligible. Bidders must be registered with bidnetdirect. com and may be required to undergo background checks and fingerprinting.

Protests must be submitted in writing within ten business days after such an aggrieved person knows, or should have known, of the facts giving rise thereto.

Contacting any other CDOC personnel regarding this procurement, unless specifically authorized, may result in disqualification. Failure to submit required documentation or comply with accessibility requirements may also lead to disqualification.

Delivery must be made on dates and during hours as specified in the contract. Noncompliance may result in rejection unless prior approval is granted by the director of dietetic services.

Payments will be made upon receipt of invoices after commodities have been delivered and accepted.

Items designated for the federal government donated commodity program will be awarded by the lowest bid.

If the vendor fails to remove rejected commodities, the state may purchase on the open market and charge the vendor any increase in price plus **** for liquidated damages. Partial or late deliveries or incorrect items may be rejected and any difference in price for repurchase will be charged to the defaulting vendor, plus **** for liquidated damages.

Samples may be submitted to the DPW Dietary Advisory Committee for formal evaluations and approval. Samples must be properly labeled and identified with bidder information.

No further awards will be made to any firm with any unpaid laboratory bill or unpaid surcharge/liquidation assessment.
