The city's standard payment terms are net 30, meaning payment is due in 30 days after receipt and acceptance of items ordered and a valid invoice. Proposals will be evaluated and ranked based on a combination of factors: quality, biological health, survival rate track record (25%), maintenance warranty (10%), experience and qualifications of the company (20%), cost (20%), and transportation/delivery timeliness (25%). The city reserves the right to select a responsive, responsible vendor on the basis of best value that is most advantageous to the city.
Proposers must be experienced and qualified vendors with sufficient experience in furnishing various species of trees. They must also meet minimum standards for responsible proposers, including adequate financial resources, ability to comply with delivery schedules, satisfactory records of performance and integrity, and eligibility for award. A prospective proposer must affirmatively demonstrate responsibility and must meet the following requirements.
If a vendor fails to perform in accordance with the contract, the city reserves the right to terminate the contract immediately and may exercise any right or pursue any remedy available at law or in equity for breach of contract. The city of longview reserves the right to terminate the contract immediately in the event contractor fails to. 1. meet schedules 2. defaults in the payment of any fees or 3. otherwise perform in accordance with these specifications.
The city representative has the right to inspect trees at the place of growth, prior to delivery, and when delivery is made. Proposers not adhering to submission instructions may be disqualified. Non-responsive proposals, which are not timely submitted or fail to meet material terms and conditions, will not be considered. Proposers not adhering to these instructions may be disqualified without further consideration.
