The East Orange Board of Education is seeking proposals for Legal Services - Environmental Counsel for the **** school year. Proposals must be submitted by Tuesday, March 31, 2026, by 10:00 a. m. All necessary RFP specifications and proposal forms can be obtained by written request to Rochelle Gabriel, Qualified Purchasing Agent. Respondents must comply with N. J. S. A. 10:5-31 et seq. , and N. J. A. C. 17:27 et seq. The Board reserves the right to reject any proposals. Vendors are reminded of ethical purchasing practices and prohibitions against offering gifts or gratuities. Specific requirements include affirmative action, compliance with the Americans with Disabilities Act, and adherence to the New Jersey Antibullying Bill of Rights Act. A business registration certificate is required. The award of the contract will be made by resolution of the Board of Education within sixty (60) days of proposal receipt. Insurance and indemnification requirements are detailed, including commercial general liability, automobile liability, and cyber security liability. A fee proposal schedule with hourly rates for legal services and support staff is required. The evaluation process will consider technical criteria, management criteria, and cost criteria, with a 100-point system. Presentations and interviews may be required. The Board intends to award the contract to the most advantageous response, considering price and other factors.

Every effort will be made to pay vendors and contractors within thirty (30) to sixty (60) days provided the board of education receives the appropriate documentation. Pursuant to the New Jersey Prompt Payment Law N. J. S. A. 18A:18A10. 1, unless otherwise provided for in the contract, the required payment date shall be ninety (90) calendar days from the date specified in the contract or if no required payment is specified in the contract, then the required payment date shall be 90 calendar days from the receipt of a properly executed invoice, or 90 calendar days from the receipt of goods or services, whichever is later. Interest shall not be paid unless goods and/or services have been rendered. All payments are subject to approval by the board of education at a public meeting.
The award of the contract will be made by resolution of the Board of Education. The award must be made within sixty (60) days of the receipt of the proposals, however subject to extension pursuant to N. J. S. A. 18A:18A36. The board of education intends to award the contract to the respondents whose response is the most advantageous to the board, price and other factors considered, and who will provide the highest quality service at fair and competitive prices.
Respondents shall submit documentation highlighting qualifications and experience they have that will assist the school district in the evaluation and selection process. Such documentation may include, but not be limited to: evidence of providing services as listed in the specifications to public school districts with experience providing services to SDA districts, formally known as Abbott districts preferred letters of recommendation from 3 public school districts in New Jersey. Experience working for the East Orange BOE will constitute one letter. Copies of professional licenses that are required to perform the services as listed in the specifications.
There may be deducted from the amount payable to the contractor by the contracting public agency, under this contract, a penalty of **** for each person for each calendar day during which such person is discriminated against or intimidated in violation of the provisions of the contract. This contract may be canceled or terminated by the contracting public agency, and all money due or to become due hereunder may be forfeited, for any violation of this section of the contract occurring after notice to the contractor from the contracting public agency of any prior violation of this section of the contract.
The board of education may consider a written request from a respondent to withdraw a proposal if the written request is received by the school business administrator before the advertised time of the proposal opening. After the proposal opening, the board of education may consider a written request from a respondent to withdraw a proposal if the written request is received by the school business administrator within five (5) business days after the proposal opening.
