Vendors are required to acknowledge reading and understanding the instructions to bidders, insurance requirements, draft sample contract, specifications, project drawings, and employee classification act. Insurance certificates and required endorsements are required at the time of contract execution. Vendors are strongly encouraged to send the insurance requirements and endorsement information to their insurance agent prior to bid closing in order to expedite the contract execution process. A performance bond and payment bond will be required upon award of contract for those companies selecting the level 2 up to $24,**** and level 3 up to $49,**** thresholds. Vendors shall not assign, transfer, convey, sublet, or otherwise dispose of any award or any or all of its rights, title, or interest therein, or delegate the duties hereunder without the prior written consent of the city. If awarded the contract, the vendor will abide by the law, notarize and attach the employee classification act affidavit to the contract. Vendors must acknowledge reading and understanding the current city of lincoln standard specifications for municipal construction and lincoln standard plans including general provisions and requirements, and material and construction specifications. It is the bidder's responsibility to promptly notify the purchasing department staff prior to the close of the bid of any ambiguity, inconsistency or error which they may discover upon examination of the bid documents including, but not limited to the specifications. References must be attached on company letterhead to the response attachment section of this bid. As a vendor who is legally considered an individual or a sole proprietor, the vendor understands and agrees to comply with the requirements of the United States Citizenship Attestation Form. All awarded vendors who are legally considered an individual or a sole proprietor must complete the form and submit it with contract documents at time of execution. If a vendor indicates on such attestation form that he or she is a qualified alien, the vendor agrees to provide the US citizenship and immigration services documentation required to verify the vendor's lawful presence in the United States using the Systematic Alien Verification for Entitlements (SAVE) program. The vendor further understands and agrees that lawful presence in the United States is required and the vendor may be disqualified or the contract terminated if such lawful presence cannot be verified as required by neb. rev. stat. 4108. The vendor understands and agrees to comply with the requirements of the Foreign Adversary Prohibition Act and has completed and uploaded the certification form in the response attachments tab in ebid. If a vendor indicates on such certification form that the company is a scrutinized company, the vendor must meet the exception requirements under the act and agrees to provide documentation to verify the exception requirements with the bid response. The vendor further understands and agrees that any scrutinized company that violates the certification may be subject to action by the Nebraska Attorney General, civil penalty, and such violation may void the contract.
