Vendors must demonstrate capability, experience, and ability to provide the required services, including meeting the definition of an Indian Economic Enterprise (IEE) and receiving at least 51% of the earnings from the contract. To be considered a capable source, responses must directly demonstrate the companys capability, experience, and ability to provide services as shown below.

Failure to address specific items in the capability statement, such as demonstrating IEE status and earnings distribution, could exclude a firm. Failure to address these items in your capability statement could exclude your firm from being determined a capable iee isbee source.

Payments may be made by check or electronic funds transfer (EFT). Contractor payment requests are made through a charge to the FDIC purchase card with the third party. Payments made or due by the third party are not subject to the prompt payment act.

FDIC will accept the contractors commercial warranty, but does not accept a disclaimer of the implied warranty that the items delivered hereunder are merchantable and fit for use for the particular purpose described in this contract. Additionally, FDIC does not accept a disclaimer of any warranties expressly provided for in the contract.
