A vendors allegation as to its confidential business information shall not be binding on the state. Any vendor submitting a bid or using the procedures discussed herein expressly accepts the states absolute right and duty to independently assess the legal and factual validity of any information designated as confidential business information. Accordingly, vendors assume the risk that confidential business information included within a bid may enter the public domain.
