Proposers must demonstrate development experience with at least one comparable project involving commercial development, preferably on a coastal, waterfront, or structurally complex site, and operational experience. They must also have a minimum of 5 years experience operating a restaurant and/or food service, retail or marketplace environments, and marine fishing concessions, along with demonstrated financial capacity to finance the project.

Offerors must have a current commercial and governmental entity CAGE code or NATO commercial and governmental entity NCAGE code, and active registration in the System for Award Management (SAM), to include assignment of a unique entity identifier (UEI). Offerors must also be registered in the Joint Contingency Contracting System (JCCS) and maintain an acceptable risk rating.

The US government reserves the right to terminate this contract for default if the contractor is no longer registered in the JCCS or fails to maintain an acceptable risk rating status at any time during contract performance. If the prospective awardee does not have an acceptable status in JCCS at the time of award, they will be found not responsible and their proposal will be ineligible for award.

The magnitude of this project is expected to be between $1,000,000 and $5,000,000.

Engines must be brand new and domestically manufactured and actively managed in the DLA federal logistics system under an established national stock number NSN.

Phase 1 proposals were due no later than 12:00 PM U. S. Eastern Time on July 20, 2026. Revised past performance submissions were due no later than August 3, 2026.

Delivery may be a factor in determining best value award. Vendor must contact TPWD point of contact to schedule delivery date and time, providing one week notice. Delivery in calendar days after receipt of order.

Payment normally will be made to the contractor within 30 days after receipt of a properly prepared invoice or the receipt of and the acceptance of goods/services ordered, whichever is later.

The unit shall be warranted against defects in material and workmanship for the manufacturer's standard warranty for government use. The warranty begins on the date the unit is determined to meet specifications and accepted by TPWD.

TPWD will award a contract to the respondent whose quote is considered to be the best value to TPWD, price and other factors considered. Factors may include lowest price, ability/qualifications, delivery schedule, and past performance.

TPWD will only award a contract to an actively licensed marine dealer, manufacturer, or manufacturer's authorized distributor. Documentation is required if a respondent is a manufacturer's authorized distributor.

Default in promised delivery days after receipt of order without accepted reasons or failure to meet specifications authorizes TPWD to purchase goods and services elsewhere and charge any increased costs to the contractor.

A pre-delivery inspection of assembled boats with accessories, outboard motor, and boat trailer is mandatory prior to scheduling delivery. The inspection will be performed at the vendor's facility.

Failure to sign the bid, failure to take exception to specifications or provide reference data, or prohibited communications may result in bid disqualification.
