This bid seeks labor and materials pricing for commercial/residential boiler inspection, maintenance, and repair services for various Rockland County facilities. The contract will be governed by New York State law. Bidders must comply with ethics regulations and submit a non-collusive bidding certification. Prevailing wage rates apply to public works and building services contracts. Purchases are exempt from New York State and local sales taxes. The county reserves the right to waive informalities or reject bids. Bids must be complete, legible, and signed. Extraneous terms may result in rejection. Samples may be requested. The county is not liable for expenses incurred prior to contract execution. Awards will be made within 45 days of bid opening.
Delivery must be made as ordered and in accordance with the terms of the contract. Unless otherwise specified, delivery shall be made within thirty calendar days after receipt of a purchase order by the contractor.
Prompt payment discounts will not be considered in determining the low bid, but may be considered in resolving tied bids. Any notation indicating that the price is net, e. g. , net 30 days, shall be understood to mean only that no prompt payment discount is offered.
The contractor shall be solely responsible for assuring that deliveries are made to personnel authorized to accept or deliver on behalf of the authorized user. Any losses resulting from the contractor's failure to deliver product to authorized personnel shall be borne exclusively by the contractor.
The commissioner reserves the right to investigate or inspect at any time whether or not the product, qualifications or facilities offered by the bidder meet the requirements set forth in the bid documents. Contractor must be prepared, if requested by the commissioner, to present evidence of experience, ability and financial standing.
There may be deducted from the amount payable to the contractor by the state of municipality under this contract a penalty of five dollars for each person for each calendar day during which such person was discriminated against or intimidated in violation of the provisions of the contract.
Where a site inspection is required by the bid specifications or project definition, bidder shall be required to inspect the site, including environmental or other conditions or pre-existing deficiencies in the installed product, equipment or environment, which may affect bidders ability to properly deliver, install or otherwise provide the required product.
The commissioner reserves the right to request from the bidder/contractor representative samples of the product offered at any time prior to or after award of a contract. Unless otherwise instructed, samples shall be furnished within the time specified in the request.
Bidder may be disqualified from receiving awards if bidder, or anyone in bidder's employment, has previously failed to perform satisfactorily in connection with public bidding or contracts.
