Proposals must be received no later than 12:00 PM Mountain Standard Time/Daylight Time on June 24, 2026.

Payment terms are Net 30.

Offeror warrants the goods and/or services furnished to be exactly as specified in any resultant agreement, free from defects in offeror's design, labor, materials and manufacture, and to be in compliance with any drawings or specifications incorporated herein and with any samples furnished by offeror. All applicable UCC warranties express and implied are incorporated herein.

The offeror selected for the award will be chosen on the basis of the greatest benefit to UNMHSC, not on the basis of lowest price.

Offerors must provide a business profile, financial information, and at least two references from customers within the last three years.

The procurement code imposes civil and criminal penalties for its violation. New Mexico criminal statutes impose criminal penalties for bribes, gratuities, and kickbacks.

If a site is referenced in this RFP, it is available for inspection. Arrangements may be made by contacting the individual listed on the cover sheet.

Failure to comply with instructions, specifications, and standard terms and conditions may result in an offer being classified as unresponsive and disqualified.

Proposals must be electronically uploaded by Tuesday, July 7, 2026, at 10:00 AM prevailing time.

Award shall be made to the responsive, responsible concessionaire whose proposal is determined to be the most advantageous to the city, based on lease fee (25%), experience (25%), safety staffing (20%), menu (10%), action plan (10%), and additional information (10%).

Proposers shall have demonstrated ability and experience in the operation of a concession foodservice business, with a minimum of three years of experience required. A record of past experience and references must be supplied.

A contractor, subcontractor, or supplier who fails to provide proof of business registration or provides false business registration information shall be liable to a penalty of **** for each day of violation, not to exceed $50,000 for each business registration not properly provided or maintained.

Respondents shall be eliminated from competition if they do not meet applicable federal, state, or county legal requirements. Failure to provide proof of business registration or providing false information can result in penalties. Failure to remedy defaults within five days of notice can lead to contract termination.

Proposals are due by Tuesday, June 30, 2026.

The college shall process the contractor's payment within thirty 30 days from the receipt of a valid invoice to the college's accounts payable office.

Selection will be based on the quality and value of the proposal, including comprehensiveness and responsiveness to the requirements outlined in this RFP. The proposals will be evaluated based on experience (20%), services offered (30%), food pricing (30%), and financial (20%).

The proposer must demonstrate a minimum of five 5 years of continuous experience providing comprehensive dining services, including retail operations and catering services, and residential dining where applicable. Experience must include the simultaneous management of multiple food service venues under a single contract. Experience serving Florida colleges and other institutions of higher education is preferred.

Failure to comply with utility conservation may result in a penalty equal to half of the applicable utility bill for that month. Failure to remit commission payments by the required deadline may result in a five percent 5 late charge.

The college will conduct optional site walks to review bidding processes, requirements, and specifications of the RFP on by appointment before June 22, 2026.

All notices of protest must be filed within 72 hours of the posting of the college's decision. Any formal protest must be filed within 10 days of the notice of protest.

Any proposal may be rejected if it is conditional, incomplete, or deviates from specifications in this RFP. If the college determines that a protest is frivolous, the party originating the protest may be determined irresponsible and that party may be determined to be ineligible for future contract awards.

The award will be made to the responsive and responsible offeror whose proposal is most advantageous to KCTCS, based on technical criteria (maximum 400 points) and cost evaluation (10 points). Oral presentations may be used. The award of this contract will be made by kctcs procurement to payment services after evaluation by the committee selected solely for this purpose.

Offerors must be qualified, experienced, financially sound, and responsible, with sufficient qualified staffing resources and appropriate financial resources. The offeror should have sufficient qualified staffing resources demonstrate experience be ordinarily engaged in the business of providing the requested services and have the appropriate financial resources to provide the services specified in this rfp.

Proposals may be rejected for failure to conform to essential requirements, imposing conditions that modify terms, failure to sign required documents, unreasonable pricing, or if the offeror is not qualified. Grounds for the rejection of a proposal include, but shall not be limited to: failure of a proposal to conform to the essential requirements of the solicitation.
