Proposals are due September 24, 2025, at 5:00 PM CST. Proposals will be opened September 25, 2025, at 10:30 AM. A non-mandatory pre-proposal meeting will be held September 10, 2025, at 9:00 AM. Proposals must be accompanied by a certified or cashier's check or bid bond equal to 5% of the total proposal amount. The contractor must submit a Contractor's Proposal Disclosure Statement and a Subcontractor's Proposal Disclosure Statement. The contractor must submit a performance bond and payment bond. The contractor must agree to receive payments via ACH direct deposit. A tax identification number (TIN) is required. The contractor must acknowledge receipt of any addenda issued during the proposal period. The contractor must visit the sites of the proposed work and fully acquaint themselves with the existing conditions. The contractor must provide barricades, flares, warning signs, and/or flagmen to mitigate danger and inconvenience. The contractor must provide a job safety analysis (JSA) form. All materials used on the job must bear appropriate EPA registered labels. The contractor must supervise their employees. The BPU reserves the right to reject any or all proposals, to waive irregularities or informalities in any or all proposals, and to accept any proposal which is deemed to be in the best interest of the board.

Successful vendors will be required to receive payments directly through automated clearing house (ACH) direct deposit in lieu of a paper check.
The contractor shall warranty and guarantee the work, equipment, and materials for a period of at least one year after date of final acceptance in writing by the owner.
The determining factors for award criteria are: price (30%), compliance with requirements of the technical specifications (30%), quality of performance on previous work on similar contracts (30%), and safety record (10%).
The BPU will refuse to enter into a contract or other transaction with an individual, sole proprietorship, joint venture, limited liability company or other entity indebted to BPU.
If the contractor fails to execute the contract and to furnish satisfactory performance and payment bonds and insurance certificates within ten 10 days from the date on which he is notified that his proposal has been accepted, the amount of his check or bid bond shall be forfeited to the BPU as mutually agreed to liquidated damages, and not as a penalty.
Each contractor shall visit the sites of the proposed work and fully acquaint themselves with the existing conditions there relating to services and labor, and shall fully inform themselves as to the facilities involved, the difficulties and restrictions attending the performance of the contract.
