The unit shall be warranted against defects in material and workmanship for the manufacturer's standard warranty for government use. all items must be covered by the manufacturers warranty.

The award will be based on best value, which may include lowest price, ability, qualifications, experience, delivery schedule, past performance, and life cycle costs. tpwd will award a contracts to the respondents whose quote is considered to be the best value to tpwd, price and other factors considered.

Bidders must certify they are eligible and not subject to suspension or debarment. respondent certifies that the responding entity and its principals are eligible to participate in this transaction and have not been subjected to suspension, debarment, or similar ineligibility determined by any federal, state or local governmental entity

Default in promised delivery authorizes TPWD to purchase goods elsewhere and charge any increased costs to the contractor. default in promised delivery without accepted reasons or failure to meet specifications authorizes tpwd to purchase goods and services of this contract elsewhere and charge any increased costs for the goods and services, including the cost of resoliciting, to the contractor.

The contractor warrants all work for one year or the manufacturer's warranty period, whichever is later, after final acceptance. contractor agrees that for a period of one year or the period of time specified elsewhere in the contract or in any guarantee or warranty provided by any manufacturer or supplier of equipment or materials incorporated into the work, whichever is later after the date of final acceptance,

The district will evaluate based on qualifications, references, overall fit with JCSD, scope, and pricing to determine the most qualified vendor. jcsd will evaluate the qualifications, references, overall fit with jcsd, as well as take into consideration the proposed scope and pricing submitted to determine the most qualified vendor.

Minimum requirements include three similar projects in the last five years, sufficient staff, and no outstanding complaints. 1. have a minimum of three 3 similar projects within the last five 5 years providing the same or similar services requested in this rfp.

Liquidated damages are set at a fixed sum per day for delay beyond the contract time. it is agreed that the contractor shall pay to the district as fixed and liquidated damages, and not as a penalty, the sum of insert writtendollar amount dollars insert numerical dollar amountper day for each and every calendar day of delay beyond the contract time or beyond any completion schedule, construction schedule or project milestones established pursuant to thecontract.

The district may conduct site visits or tours of the candidates' places of business during the evaluation period. during the evaluation period, the district may do any or all of the following: generate a short list and conduct interviews with the top candidates conductonsite visits and/or tours of the candidates places of business conduct negotiations with the most qualified candidates.

Written questions from vendors are due to the district by August 18, 2026, at 5:00 pm. all vendor questions, clarifications or comments shall be submitted via email only to melanie martinez, administrative specialist at 3 ***@***. *. * and must be received by the district no later than august 18, 2026 @5:00 p. m.

Failure to meet minimum requirements or submitting proposals after the deadline may result in rejection. proposals received after that date and time will be rejected by the district as nonresponsive and returned unopened.
