This document outlines the general conditions of a construction contract for the Black Sandy SP Boat Dock Ramp Improvements. It details the roles and responsibilities of the owner (State of Montana) and the contractor, including contract documents, site conditions, supervision, labor, wages, materials, warranties, taxes, permits, and administration of the contract. The contractor is responsible for all aspects of the work, including quality control, safety, and compliance with laws and regulations. The architect-engineer acts as the owner's representative. The document also covers submittals, site access, cleanup, and indemnification. Prevailing wage and Montana resident hiring preferences are specified.
The State of Montana has established a billing cycle for processing payments in article 9 of these general conditions.
The contractor warrants to the owner and architect-engineer that materials and equipment furnished under the contract will be new and of good quality, and that the work will be free from defects. The contractor warrants all work, workmanship, and materials for a full warranty period of one calendar year from the date of final acceptance, with a two-year warranty for the roofing system.
The contractor is required to be registered with the department of labor and industry. The owner's engagement of the contractor is based on the contractor's representations that it has the requisite skills, judgment, capacity, expertise, financial ability, and experience to perform the work, and is authorized, licensed, and registered to perform the labor and services.
If the contractor fails to correct work not in accordance with contract documents, the owner may issue a written order to stop the work. If the contractor defaults or neglects to carry out the work, the owner may correct deficiencies and deduct the cost from payments due to the contractor.
Execution of the contract by the contractor constitutes a representation that the contractor has visited the site and become generally familiar with local conditions.
Samples are physical examples which illustrate materials, equipment or workmanship and establish standards by which the work will be judged. The contractor shall review, approve, and submit samples required by the contract documents.
