The bid notice states that delivery of equipment is required no later than 45 calendar days from the award of the contract. The seller shall ensure the package is appropriately marked with the contract number, delivery address, and contracting officers representative information. No partial delivery is authorized. The seller shall notify the contracting officer representative three business days before delivery and include providing tracking information.

The deadline for bid submissions is Wednesday, June 10, 2026, by 2:00 PM. The delivery date shall be one of the determining factors in selecting the best bid for the City, and bidders must indicate the number of calendar days to complete work in full after receipt of order.

The bid notice states that payment terms are Net 30 unless otherwise specified by the City. Prompt payment discounts will be used by the City in determining the lowest responsible bidder.

The City reserves the right to award the bid in whole or in part, or to separate bidders for each item/group, or to award one contract for the entire bid, as determined to be in the best interest of the City. The City also reserves the right to take into consideration contract administration costs for multiple award contracts and to make an award of the bid as may be deemed to the best advantage of the City.

Bidders must be qualified and submit all required documents as listed on the bid checklist, including the Respondent Acknowledgement Form, Bid Checklist, Bid Sheet, Conflict of Interest Questionnaire, Nonexclusion Affidavit for General Contractors, Prohibition on Contracts with Companies Boycotting Israel, Certification Statement, IRS W9, and Texas Secretary of State filing certificate/partnership agreement. Failure to complete and provide any of these bid requirements may result in the respondent's proposal being deemed nonresponsive and therefore disqualified from consideration.

The City of Mesquite reserves the right to enforce the performance of this contract in any manner prescribed by law or deemed to be in the best interest of the City in the event of breach or default of this contract. City of Mesquite reserves the right to terminate the contract immediately in the event the successful proposer fails to meet delivery or completion schedules or otherwise perform in accordance with the accepted proposal. Breach of contract or default authorizes the City to award to another proposer, purchase elsewhere, and charge the full increase in cost to the defaulting proposer. If the product or training is not in conformance with the specifications and requirements of the City, the vendor shall redo and complete any work necessary, bringing the product or training into compliance at the vendor's expense.

Proposals that do not include all the required information will be disqualified. Failure to complete and provide any of the bid requirements may result in the respondent's proposal being deemed nonresponsive and therefore disqualified from consideration. Any contact or attempt to contact any other employee of the City regarding this RFP may result in the immediate disqualification of the proposer.
