The bid notice states if the contractor andor supplier fails to complete the contract within the specified delivery date orwithin any extensions thereof granted in accordance with this section, the city may elect to permit thecontractor andor supplier to proceed with and complete the contract, provided, however, that in any suchcase such permission shall not be deemed a waiver in any respect by the city of the contractors andorsuppliers liability for damages or expenses thereby incurred by the city as a result of the failure to completedelivery within the specified time, but such liability shall continue in full force against the contractor andorsupplier as if such permission had not been granted.
