Payment will be made within 30 days after receipt of an invoice, or in the event of a dispute, the undisputed amount will be paid promptly.

An award will be made to the lowest cost bid that is determined to be in the best interest of the city. The quality of the articles, their conformity with specifications, their suitability to the requirements of the city, and the delivery terms will be taken into consideration.

Qualified firms are invited to submit bids. Vendors must certify they have not been barred from bidding by federal, state, or local governments and have not been suspended or debarred from receiving federal funding.

Samples of items, when required, must be submitted within the time specified and at no expense to the city. If not destroyed in testing, they will be returned at the proposer's request and expense.

Standard payment term is Net 30 days, effective from the date of a valid invoice document. Payment commences upon the later of the receiving county department receiving goods or services into the county's payment system, or county financial operations receiving and verifying the contractor's invoice.

Contractor warrants goods or services to be satisfactory and free from defects. Contractor also warrants that all products and services provided under this contract are non-infringing.

County will tabulate responses that are responsive and responsible to determine which are most advantageous to county considering the specifications stated in the offer agreement and other relevant factors. County will determine the low or lowest bids considering all items listed in the unit price schedule. County may award on the basis of price and other factors, including but not limited to such factors as delivery time, quality, uniformity of product, suitability for the intended task, and bidders ability to supply.

Offerors must be qualified, responsible, and willing to provide asphaltic concrete and/or heatless road repair tack in compliance with all solicitation specifications and requirements. Contractor must have been in the business of providing asphaltic concrete and/or heatless road repair tack for a minimum of three consecutive years.

An interested party may file a protest regarding any aspect of a solicitation, evaluation, or recommendation for award. The five-day period to file a protest of the award will be measured from the date the notice of recommendation for award is posted on the Bidnet portal.

Failure to comply with solicitation requirements, including but not limited to submittals that do not contain all documents, or that modify the solicitation requirements, may be cause for county to reject offeror's bid as non-responsive and not evaluate it.

Bidder accepts the provisions of the agreement for liquidated damages in the event of failure to complete the work on time.

If bidder fails to specify a subcontractor for any portion of the work or specifies more than one subcontractor for the same portion of work, bidder shall be deemed to have agreed that bidder is fully qualified to perform that portion and cannot sublet or subcontract that portion of the work.
