The State of Nebraska, Department of Health and Human Services (DHHS), is seeking proposals for Nebraska Tobacco Quitline Services. The contract will be for an initial term of two years with options to renew for three additional two-year periods. Bidders must be qualified and experienced in tobacco cessation services. Key requirements include providing a 24/7 telephone and web-based quitline, offering counseling, screening for medical contraindications, and potentially providing Nicotine Replacement Therapy (NRT). The vendor must also provide technical assistance and online training for healthcare professionals, including continuing education units. Reporting on quit rates, participant demographics, and service utilization is mandatory. The vendor must comply with all state and federal laws, including HIPAA. No physical call center is required. The opening date for proposals is May 7, 2026.
The initial term of the contract will be two years commencing July 1, 2026, through June 30, 2028. The contract includes the option to renew for three additional two-year periods upon mutual agreement of the parties. DHHS reserves the right to extend the period of this contract beyond the termination date when mutually agreeable to the parties.
Invoices for payment must be submitted by the vendor to the agency requesting the services with sufficient detail to support payment. The state shall have forty-five 45 calendar days to pay after a valid and accurate invoice is received by the state.
The vendor represents and warrants that its services hereunder shall be performed by competent personnel and shall be of professional quality consistent with generally accepted industry standards for the performance of such services and shall comply in all respects with the requirements of this agreement. For any breach of this warranty, the vendor shall, for a period of ninety 90 days from performance of the service, perform the services again, at no cost to the state, or if vendor is unable to perform the services as warranted, vendor shall reimburse the state all fees paid to vendor for the unsatisfactory services. The vendor warrants for a period of one 1 year from the date of acceptance that: a the products perform according to all specific claims that the vendor made in its response to the solicitation, b the product is suitable for the ordinary purposes for which such product is used, c the product is suitable for any special purposes identified in the solicitation or for which the state has relied on the vendors skill or judgment, d the product is designed and manufactured in a commercially reasonable manner, and e the product is free of defects.
Solicitation responses that are deemed responsive to the solicitation will be evaluated. Each evaluation category will have a maximum point potential. The state will conduct a fair, impartial, and comprehensive evaluation of all responses in accordance with the criteria set forth below. Areas that will be addressed and scored during the evaluation include: Corporate Overview, Technical Response, and Cost Sheet.
Bidder shall provide proof of active membership in the North America Quitline Consortium (NAQC) within the last five 5 years. Bidder must demonstrate five 5 years experience in tobacco cessation services serving diverse clients and providing awareness/participation in accordance with NAQC efforts. Bidder shall provide evidence of three 3 successful clients utilizing similar scope of this RFP within the last five 5 years. Bidder or any proposed subcontractors cannot have a current, or within the past five years, contract or affiliation with tobacco companies.
Violation of the terms and conditions contained in this solicitation or any resultant contract, at any time before or after the award, shall be grounds for action by the state which may include, but is not limited to, rejection of a bidders solicitation response, withdrawal of the intent to award, withdrawal of the award, negative documentation regarding vendor performance, termination of the resulting contract, legal action and suspension or debarment of the bidder from further bidding with the state for the period of time relative to the seriousness of the violation.
The solicitation does not require the submission of samples.
Any protests must be filed by a bidder within ten 10 business days after the intent to award decision is posted to the internet.
