Eastern New Mexico University (ENMU) is seeking proposals for general legal counsel services on an as-needed basis. The contract will be for an initial one-year period with three one-year renewal options. Proposals are due by July 10, 2026, at 2:00 PM MST. The evaluation criteria include technical specifications (experience, knowledge, communication, accessibility, references) and business specifications (cost). ENMU reserves the right to award to multiple vendors. All proposals must be submitted in sealed packages and adhere to the specified format. Failure to comply with requirements may result in disqualification. Protests must be submitted in writing to the protest manager.
Proposals must be received no later than 2:00 PM Mountain Standard Time on July 10, 2026. Proposals received after this deadline will not be accepted.
Upon written request from the seller for payment, the university shall, within 30 days, issue a written certification of complete or partial acceptance or rejection, with payment to follow within 30 days after certificate of acceptance. Late payment charges shall be one and one-half percent per month as set forth in section **** NMSA ****.
The seller agrees that the tangible personal property or services furnished under this agreement shall be covered by the most favorable commercial warranties the seller gives to any customer for such tangible personal property or services. Vendor agrees not to disclaim warranties of fitness for a particular purpose or merchantability.
The contract shall be awarded to the offeror or offerors whose proposals are most advantageous to the agency taking into consideration the evaluation factors set forth in this RFP. The most advantageous proposal may or may not have received the most points.
The evaluation committee may make such investigations as necessary to determine the ability of the potential offeror to adhere to the requirements specified within this RFP. The evaluation committee will reject the proposal of any potential offeror who is not a responsible offeror or fails to submit a responsive offer.
The procurement code, NMSA ****, **** through ****, imposes civil, misdemeanor and felony criminal penalties for its violation. In addition, the New Mexico criminal statutes impose felony penalties for bribes, gratuities and kickbacks.
The 15 calendar day protest period shall begin on the day following the award of contracts and will end at 5:00 PM Mountain Standard Time/Daylight Time on the 15th day. Protests must be written and must include the name and address of the protestor and the request for proposal number.
Failure to complete and return the signed unaltered Campaign Contribution Disclosure Form or Letter of Transmittal Form will result in disqualification. Failure to adhere to this requirement [securing written approval prior to release of information] may result in disqualification of the offeror's proposal or removal from the contract.
