All work items shall be substantially completed within 60 calendar days following the date the contractor is notified to proceed with the work. The completion date of December 20, 2026 is critical.

The owner will pay the contractor each month, within 60 days of the date of the monthly estimate, a sum equal to ninety-five percent (95%) of the monthly estimate, retaining five percent (5%) until substantial completion.

The contractor guarantees all work against defects in materials or workmanship for a period of twelve months following the date of the notice of substantial completion.

The contract will be awarded to that responsible bidder whose bid, after corrections and adjustments, totals the least number of dollars.

All bidders must be registered with the New York State Department of Labor (NYSDOL) and submit a copy of their certificate of registration with their bid.

For each calendar day after December 20, 2026, that the project is not completed, the contractor shall pay agreed-upon damages ranging from $50 to $500 per day based on contract amount.

Requests for interpretations must be received by the engineer at least seven (7) days prior to the date set for the opening of bids.

Bids will not be accepted from bidders determined to be a nonresponsible entity by the New York State Office of General Services in accordance with general municipal law ****.
