Goods must be delivered on or before the date on each specification sheet. Early delivery requires written request at least one week prior. vendor shall deliver the goods on or before the date included on the individual bid specification sheets.
Payment follows the Local Government Prompt Payment Act after delivery, inspection, and acceptance. payment shall be made in accordance with the local government prompt payment act 50 ilcs **** et seq. following the delivery of the goods and only upon inspection and acceptance of the goods by the park district.
Vendor warrants goods are new, defect-free, and conform to specifications. Defective goods will be rejected and replaced at vendor's expense. the vendor warrants to the park district that all goods furnished will be of good quality and new, that the goods will be free from defects. . .
Award to the lowest responsive and responsible bidder, but not on price alone. the park district does not award on price alone and will also consider the ability of the bidder to provide experienced labor. . . conformity with the specifications, delivery terms, serviceability, quality, and the financial capability. . .

Failure to deliver on time may result in immediate contract termination. should the contractor fail to deliver the goods on or before the required delivery schedule date. . . the park district shall have the right to immediately terminate the contract. . .
Discrepancies or doubts about specifications must be reported in writing at least five business days before bid opening. any bidder who finds. . . a discrepancy in or omission from the specifications. . . shall notify wendy peterson in writing not later than five 5 business days prior to the scheduled opening of bids.
Bids not marked properly, incomplete categories, unapproved substitutions, or failure to submit required certifications may be rejected. failure of a bidder to complete/submit a required certification may result in immediate rejection of that bidders bid.
