The work involves furnishing and placing approximately 17,365 tons of crushed stone aggregate surfacing material for levees. Site preparation, hauling, placement, grading, and compaction are included. The contractor is subject to stipulated damages for contract time expiration. Default and termination clauses are detailed, including conditions for contractor default and agency actions. A one-year correction period for defective work is specified. Payment is based on measured quantities and unit prices, with provisions for altered quantities and force account work. Partial payments are made up to 95% of the contract price before final acceptance, with retainage. Payment for stockpiled or stored material is considered under certain conditions.
Monthly estimates will be made, with no more than 95 percent of the total contract price paid in advance of final acceptance. Retainage is 10 percent for contracts up to $500,000 and 5 percent for contracts over $500,000. Monthly estimates will be approximate and subject to correction in subsequent estimates.
A one-year correction period is provided after substantial completion for any defective work. If within one year after the date of substantial completion or such longer period of time as may be prescribed by laws or regulations or by the terms of any applicable special guarantee required by the contract or by any specific provision of the contract, any work is found to be defective, the contractor shall promptly, without cost to the contracting agency and in accordance with the contracting agency's written instructions, either correct such defective work, or if it has been rejected by the contracting agency, remove it from the site and replace it with nondefective work.
The contractor will be subject to an assessment of stipulated damages upon expiration of contract time. The contractor will automatically be subject to an assessment of stipulated damages by the expiration contract time on the project.
The contractor will be in default if they fail to complete the project within contract time, become insolvent, allow final judgments to stand unsatisfied for 14 days, make unauthorized assignments, discontinue work, fail to begin work within 10 days of notice, perform work unsuitably, fail to resume discontinued work, fail to maintain licenses, perform work unacceptably, violate contract provisions or laws, fail to follow safety standards, or are a party to fraud.
