The contract shall be signed by the successful bidder and returned, together with the contract bonds and other required contract documents, within ten 10 working days after the prescribed forms have been presented to the successful bidder for execution.

Partial payments to the contractor for work performed under the contract will be made at the rate of ninetytwo percent 92 of the estimates prepared and approved. Partial payments may be reduced or withheld entirely if, in the opinion of the director of engineering, construction is not proceeding according to the contract, or for any other violation of the contract, or for failure of the contractor to submit proper federal, state or equal employment opportunity forms and compliance reports or for failure of the contractor to comply with orders of the city, or pending settlements of claims or liens filed against the contractor.

The contractor shall guarantee against defects, all materials and workmanship furnished under these specifications. Length of guarantees shall be as specified.

The award of a contract, if awarded, will be made to the lowest and best bidder whose bid complies with all the requirements prescribed, on the basis of utilizing the lowest priced acceptable alternatives for items where alternate bids are taken.

The bidder must furnish on the form included in the bid bqq13 information such as evidence of financial responsibility, a list of available facilities including equipment and personnel, and evidence of ability to perform the contract based upon projects of similar nature.

Should the contractor for the work become liable for assessment of liquidated damages for reasons set forth in the general conditions of these specifications, the contractor and his surety shall pay to the city one thousand dollars 2, **** for each calendar day for which such liquidated damages are assessed.
