The service area commissioner or designee must accept work completed for the requested services as a condition of final payment. If acceptance is unreasonably withheld, the borough attorney may authorize final payment without service area commission acceptance.

The bidder warrants all articles, materials, and equipment supplied under a contract resulting from this bid conform to the specifications of this contract, to be fit and sufficient for the use specified, to be of merchantable quality, and to be free from defect of materials or workmanship.

Award will be made for each service area to the low responsive, responsible bidder meeting all requirements set forth in the bidding documents. Award shall be based on the sum of the total costs for requested routine maintenance work services and requested public construction work services.

A business license, certificate of insurance, and signed contract documents must be received from the successful bidder within ten days after issue of the letter of award. Bids must be electronically submitted using the designated bid form to bidnet prior to the deadline. The bidder must have and keep in effect an Alaska business license and an Alaska contractors license prior to contract award.

Failure to provide required documents within the stated time may result in the termination of the award. In case of default by the contractor, the borough may procure goods or services from another source and hold the contractor responsible for any resulting excess cost or other remedies.

Bidder protests based upon any omissions, or errors, or the content of the IFB will be disallowed if not made known prior to the bid opening. A protest with respect to an IFB shall be submitted in writing prior to the opening of bids, unless the aggrieved person did not know and should not have known of the facts giving rise to such protest prior to the bid opening. The protest shall be submitted within five calendar days after such aggrieved person knows or should have known of the facts giving rise thereto.

Bids that fail to acknowledge receipt of addenda may be considered nonresponsive. Bids cannot be submitted to bidnet after the opening time. A bid may be rejected if the bidder is not in a position to perform the contract, the bid is not signed by hand, the bidder fails to furnish bid bonds or surety deposits, plans, specifications, samples, and so forth, when any were specifically called for in the IFB, and within the time limit indicated, the bidder has failed to use the required bid form, the bidder fails to provide, with the bid, descriptive literature necessary to determine the responsiveness of the bid, the bidder otherwise fails to qualify as a responsible and responsive bidder, or the borough assembly does not approve the award.

Sealed bids will be accepted until 4:00 PM local time on October 6, 2025.

Payment will be made on a monthly basis following submission of the appropriate invoices to city.

The successful bid will not be selected solely on monetary criteria. Previous records of performance of similar work and references will be used. Comparison of equipment size and condition will also be used.

All bidders will describe in detail his experience, personnel, and equipment resources. References from previous work are required. A copy of current Alaska business license and City of Valdez business registration must be included with the bid.

The penalty for not performing lot cleanup shall be loss of retainer and loss of the contract.

Bidders must visit the site to ascertain pertinent local conditions such as the location, accessibility, and general character of the site, labor conditions, the character and extent of existing work within or adjacent thereto, and any other work performed thereon.
