The Kenai Peninsula Borough School District is seeking bids for frozen food products. The contract period will be from June 1, 2026, to April 30, 2027. Bids are due by May 14, 2026, at 4:00 PM Alaska time. Delivery is upon purchase order requests, with the first delivery or pickup on the week of July 27, 2026. Delivery locations include the KPBSD Central Rec. Warehouse in Soldotna or the bidder's warehouse in Anchorage. Bidders must provide both prices. Samples are required and must be of the grade and quality of the product to be furnished, with nutritional and shelf-life information. A warranty is required for all food products. Payment will be made upon receipt, inspection, and acceptance of products. A fee of **** is required for appeals, which is refundable if the appellant prevails.
The first delivery or pickup is scheduled for the week of July 27, 2026. Subsequent orders are as required by the district, with personnel placing orders and scheduling receipt for required products 6 weeks in advance. Emergency orders may be placed with less than 6-week notice.
The bid notice states that payment will be made upon receipt, inspection, and acceptance of products. Purchase order numbers shall appear on all invoices.
The seller expressly warrants that all food products purchased will be of the best quality available and will meet the highest standard of the trade. The seller guarantees to answer personally for all food products supplied to the district and shall undertake to correct workmanship or other defects in food products found by the buyer or designee.
The district reserves the right to select final quantities and product based on total cost and cost itemization. The bid will be awarded line by line.
Bidders must be current in all payments of Kenai Peninsula Borough sales tax and personal property tax if eligible for local bidder preference. Bidders must also comply with debarment and suspension requirements.
The bid notice mentions that any person who fails to file the required anti-lobbying certification shall be subject to a civil penalty of not less than $10,000 and not more than $100,000 for each such failure. Additionally, if a contractor is found to be in violation of Kenai Peninsula Borough code of ordinances in taxation and does not remedy it within ten days of notice, any contract can be terminated for cause.
Samples may be furnished to the district at no charge and will not be returned. Samples shall be of the grade and quality of the product to be furnished, come from a regular production run in a full, sealed case, and must include nutritional and shelf-life information. A detailed explanation of the decoding procedure for dating product must also be provided.
Protests based on any discrepancy, defect, ambiguity, or other error in the solicitation will be disallowed if the fault has not been brought to the attention of the district, in writing, at least ten 10 days prior to the date set for the submission of bids. If such date falls on a weekend or holiday, the deadline shall be the last business day before the weekend or holiday. For contract awards of $25,000 or greater, any party may appeal to the superintendent in writing, personally received at the district purchasing office, within three 3 business days of the date of notice of intent to award a contract.
