The portable diesel generators shall be delivered to various locations throughout the city of Brownsville without diesel fuel. The equipment furnished hereunder shall remain property of the vendor. The BPU may reject any equipment which does not comply with the specifications. All manufacturers guarantees of equipment, if any, shall be in effect during the rental period. The vendor shall hold harmless and indemnify the BPU from any and all claims, suits, and proceedings for infringement of any patent or patents covering equipment delivered hereunder. The vendor shall not assign this contract or any part hereof without approval in writing of the BPU, and further that the vendor shall not enter into any contract with any person, firm or corporation for the performance of the vendor's obligations hereunder, or any part thereof, without the approval in writing of the BPU.
