Sealed bids for the rental of portable
diesel generators with trailers for hurricane preparedness will be received by the Brownsville Public Utilities Board until 5:00 PM on April 2, 2025. Bids will be publicly opened on April 3, 2025, at 10:30 AM. Bidders can request a copy of the bid tabulation by emailing ***@***. *. * specifications are available at www. ***. *. * rental period is approximately 6 months to 1 year, with the option to renew annually. The successful vendor must agree to receive payments via ACH direct deposit. A W9 or W8 form is required for all vendors. The Brownsville Public Utilities Board is exempt from federal excise tax, state tax, and local taxes. Failure to sign the bid will disqualify it. The contract will be placed into effect by means of a purchase order issued by the Brownsville Public Utilities Board after tabulation and final approval by the board. Delivery locations are various locations within the city of Brownsville. The vendor must specify the best available delivery date on the bid response. Additional information regarding fuel tanks, startup services, remote monitoring, and Texas sales tax is included. The tentative timeline includes vendor work on the bid from March 17, 2025 to April 2, 2025; last day to submit questions on March 28, 2025; bid opening on April 3, 2025; bid evaluation from April 4 to April 25, 2025; final recommendations on April 28, 2025; submission to the utilities board for approval on May 12, 2025; and the contract term commencing in June 2025. The BPU reserves the right to reject any or all bids, to waive irregularities or informalities in any or all bids, and to accept any bid which is deemed to be in the best interest of the board. The BPU also reserves the right to reject, rebid, accept, and/or extend the bid by up to two weeks if only one or no bid is received. The BPU reserves the right to hold the bid for 90 days from the submission date without action, and to waive all formalities in the bid. The BPU reserves the right to extend the total bid beyond the original 90-day period prior to an award, if agreed upon in writing by all parties. The BPU reserves the right to terminate for cause or convenience all or any part of the unfinished portion of the project resulting from this solicitation within thirty 30 calendar days written notice. The BPU has the right to increase or decrease quantities. The BPU reserves the right to refuse to enter into a contract or other transaction with any individual or entity indebted to the municipality. Changes or corrections will be issued by addendum. Addenda will be emailed to all who have returned the bid acknowledgement form. It is the responsibility of the vendors to determine whether all addenda have been received. The BPU may award rental of all
generators listed in the bid schedule or may select any combination of
generators. The portable
diesel generators shall be delivered to various locations throughout the city of Brownsville without
diesel fuel. The equipment furnished hereunder shall remain property of the vendor. The BPU may reject any equipment which does not comply with the specifications. All manufacturers guarantees of equipment, if any, shall be in effect during the rental period. The vendor shall hold harmless and indemnify the BPU from any and all claims, suits, and proceedings for infringement of any patent or patents covering equipment delivered hereunder. The vendor shall not assign this contract or any part hereof without approval in writing of the BPU, and further that the vendor shall not enter into any contract with any person, firm or corporation for the performance of the vendor's obligations hereunder, or any part thereof, without the approval in writing of the BPU. The following forms are required to be submitted as a part o
