The CM at Risk will not perform any portion of the project with its own forces except as may be mutually agreed to by PCS and the CM at Risk. The CM at Risk will be at risk in the proposed undertaking and will be responsible for completing the project within the GMP. Should the final cost of the project be less than the GMP, all savings shall belong to PCS. Pay applications shall be held in retention through such time that construction is complete, and PCS has taken delivery of the facility. PCS shall have the authority to suspend or terminate performance of the project at any time.
