When applicable, the contractor shall provide the manufacturer's standard warranty on all supplies at no additional cost to the college. The contractor shall understand and agree that the warranty shall commence once the college has accepted all items.

Award will be made by individual line item to the lowest responsive and responsible bidder based on the evaluated extended price.

Vendors currently on the NYS Labor Department debarred list will not be considered for award of this contract. By submitting a bid for consideration, the vendor is representing to the college that they are currently in good standing with the NYS Department of Labor at the time of the bid.

Failure to adhere to and comply with any of the conditions and specifications of this bid and the contract to follow will subject the contract to cancellation upon ten days written notice by Orange County Community College. In the event of cancellation of contract and the necessity to bid or negotiate a new contract with another vendor, the original vendor will be responsible for indemnifying the college for costs incurred in obtaining a new contract and for any increase in costs of service involved for the duration of the term of the original contract.

The college may request samples from the apparent low bidder within three business days after notice. Samples must be provided at no cost within five business days. Failure to provide a requested sample may result in rejection of the affected item.

The vendor waives any dispute or claim not made in writing and received by the college within thirty (30) days of the occurrence giving rise to the dispute or claim.

Experience with historic or architecturally sensitive buildings is preferred.
