Selection is based on the following criteria, which is either critical or is very important: ability of caterer to provide a high level of service, ability of caterer to provide high quality of all foods served without running out of said food, history of caterer to support the ability of handling large groups successfully serving all within the allotted time frame, information provided in response to the rfp, ability to provide safe food handling, overall cost of services, presentation of food in an attractive manner, experience recommendations from previous and existing clients.

At the time of bidding and throughout the contract period, the vendor must maintain an Oahu-based wholesale, brokerage, or retail business office with warehouse and inventory capabilities. Vendor must be registered and in compliance to do business in Hawaii, providing a Certificate of Vendor Compliance (CVC) obtained through Hawaii Compliance Express (HCE). At the time of bidding and throughout the contract period, the vendor must maintain an oahubased wholesale, brokerage, or retail business office with warehouse and inventory capabilities sufficient to supply and deliver the awarded items in a timely manner.

Upon request by HSH, the vendor shall mail the substitute products as samples for evaluation. If no sample is provided, the vendor will not be considered for the award. Failure to meet qualification requirements, including maintaining an Oahu-based business and providing proof of compliance, may result in rejection of the bid or award. First delivery or will call, as applicable shall occur after the issuance of a purchase order. Delivery dates will be included in the purchase orders, unless otherwise stated in the ITB. Contractor shall deliver the goods in accordance with ODOC's instructions, including delivery dates as indicated in the issued purchase order.

Payment for completion of state contracts is normally made within 30 days following the date the entire order is delivered and accepted or the date the invoice is received, whichever is later. After 45 days, contractor may assess overdue account charges up to a maximum rate of two-thirds of one percent per month (8 APR) on the outstanding balance.

All implied and expressed warranty provisions of the Uniform Commercial Code (ORS Chapter 72) are incorporated in this contract. All warranties shall run to the state. Contractor warrants that all goods shall be new, unused, current production models, where applicable, and shall be free from defects in materials, design and manufacture for the duration of this contract.

ODOC may award one or more contracts based on the lowest responsive bids by responsible bidder per line item, groups of items, or all or none, whichever is in the best interest of ODOC. Preferences for Oregon goods and services, and resident bidders will be applied.

Bidders must submit all required information as required in this ITB, including delivery information and signature page information. Failure to supply all required information shall be cause for bid rejection. Bidders must also certify that they have the power and authority to enter into and perform this contract.

If contractor fails, neglects or refuses to pay promptly as due, any claim for labor or services furnished to the contractor or any subcontractor, the state may pay such claim and charge the amount of the payment against funds due or to become due the contractor.

ODOC reserves the right to request samples after bid closing from one or more bidders during the evaluation process. If samples are requested by ODOC, bidder shall deliver samples to ODOC within four (4) days after the date of the request.

To be considered, ODOC must receive the protest by the deadline specified in Section 1. 1 Schedule of Events.

Contact with other ODOC staff regarding this ITB without prior clearance from the single point of contact will lead to disqualification. Failure to supply all required information shall be cause for bid rejection.
