Contractor guarantees each portion of the services as installed against defective materials and workmanship for a period of one 1 year from date of Citys written acceptance of the work.

Proposals are sought from qualified and experienced restaurant operators.

In the event of vendors breach of this contract, city may take actions such as requiring vendor to repair or replace goods, reject shipments, or cancel outstanding deliveries or services.

When deemed necessary by the city, an onsite inspection date and time will be so designated. The vendor is responsible for inspecting and understanding the total scope of the projects i. e. , specifications, quality, and quantity of work to be performed.

Protests of any kind regarding the solicitation must be received by the City's Purchasing Agent not more than five calendar days after the last day for questions or the last addendum is issued, whichever is later. Bid protests must be submitted to the City Manager so that it is received by the City no later than seven calendar days after the bid opening.

In case of default by the vendor of any of the conditions of this solicitation or contract resulting from this solicitation, the vendor agrees that the city may procure the articles or services from other sources and may deduct from the unpaid balance due the vendor, or collect against the bond or surety, or may invoice the vendor for excess costs so paid.
