This is a Request for Proposals (RFP) for the supply of fresh produce for the Fayette County Public Schools (FCPS) Child Nutrition Department. The contract term is from August 1, 2026, to July 31, 2027, with the possibility of four one-year renewals. Proposals are due by 2:00 PM local time EST on June 15, 2026. All questions must be submitted in writing through BidNet by June 8, 2026. Proposals can be submitted hard copy or online via BidNet. The award will be made to the responsible and responsive offeror providing the best value, considering price (800 points) and local businesses/delivery capability (200 points). Prices must remain firm for three-month periods, with requests for increases/decreases submitted 15 days prior to the end of each period, limited to a 2% variance of the CPIU. Fuel surcharges are not permitted. Past performance will be considered, and offerors with a record of poor performance may be deemed non-responsible. Successful offerors must provide invoices and comply with various federal regulations, including Buy American provisions and background checks for individuals providing services to students. A certificate of insurance is required with the proposal. Kentucky resident bidders will receive a preference. The contract may be renewed for up to four additional one-year terms.

Payments for bid items are normally approved at the regularly scheduled meeting of the Board on the fourth Monday of most months, provided bid items and invoices are properly received by the first Monday of the month. Payments may be made early to take advantage of cash discounts offered, provided the taking of such discounts is advantageous to FCPS.
The RFP shall be awarded to the responsible and responsive offerors providing the best value. In determining the best value, price is considered with 800 points, and locally owned businesses and the ability to deliver to all school sites with no minimum order required is considered with 200 points.
Offerors with a record of poor performance with the school district in the last 24 months may be found non-responsible and ineligible for award. All companies with nexus in Lexington, Kentucky must be current on all filings and payments of occupational license and net profits tax for schools. For contractors providing services to students on a regularly scheduled and continuing basis, a state criminal history background check and a letter from the cabinet for health and family services stating the individual is clear to hire based on no findings of substantiated child abuse or neglect are required.
KRS **** provides severe penalties for violations of laws relating to gratuities or kickbacks to employees designed to secure a public contract for supplies or services. FCPS reserves the right to cancel the contract if the offeror's work is unsatisfactory, their ability to meet completion schedules is unsatisfactory, or billing is found to be excessive for work performed.
Samples requested must be furnished free of expense to the board. If not destroyed or consumed in testing or evaluating, or required in connection with the award, samples will upon request be returned at offeror's expense. Right is reserved to mutilate or destroy any samples if considered necessary for testing purposes.
Any actual or prospective bidder, offeror or contractor who is aggrieved in connection with the solicitation or the award of a contract may protest to the executive director of financial accounting benefits services and the director of the department the solicitation was issued for, as the case shall require. The protest shall be submitted in writing, within 14 days after such aggrieved person knows, or should have known, of the facts giving rise thereto.
A successful offeror who submits any subsequent document for FCPS to accept/sign understands and agrees that this will not be considered or accepted by FCPS. Following the submission of a response and the award of the RFP, should a successful offeror take the position that an additional document with additional terms is required for a successful offeror to comply with terms of the RFP, the RFP award shall be considered void and offeror may be debarred from future work with FCPS. Offerors with a record of poor performance with the school district in the last 24 months may be found non-responsible and ineligible for award. Erasures or the use of typewriter correction fluid on proposal forms are unacceptable and may result in rejection of the proposal.
